2024 Red Sox Rewards Program Terms and Conditions
Program Participation and Eligibility. Participation in the Red Sox Rewards Program (the "Program"), and use of the Program membership card ("Membership Card") issued by the Boston Red Sox Baseball Club Limited Partnership (the "Club") are subject to these terms and conditions, and the rules, regulations, policies and procedures described herein, on the Membership Card, on https://www.mlb.com/redsox/rewards or otherwise communicated to Participants (collectively, "Program Terms"). The Club has the right to change, limit, or otherwise amend the Program Terms at any time in its discretion by posting them on this web page, by e-mail notification to each Participant (as defined below) or both, and reserves the right to cancel the Program at any time. Only eligible season ticket package account holders of record (each, a "Member") are eligible for Program participation (each such eligible Member, a "Participant").
Program Enrollment, Rewards Card. The Club will issue one (1) Membership Card for each Member. This card will be issued digitally.
Children's Privacy. Participants must be at least thirteen (13) years of age to be eligible to participate in the Program. Consistent with the redsox.com Privacy Policy available at https://www.mlb.com/official-information/privacy-policy, the Club will not knowingly accept personal information about any individual under the age of 13. Certain Rewards (e.g., Rewards including travel) as determined by the Club in its sole discretion are only available to Participants over the age of eighteen (18) years.
Use of Membership Card. Use of the Membership Card so issued will enroll the Participant named on such Membership Card in the Program subject to and in accordance with all of the Program Terms. Each Participant is solely responsible for controlling access to his or her digital Membership Card, and is liable for all activities and purchases conducted with such Membership Card bearing the Participant's name, whether or not such activities are conducted by the Participant. The Club is not responsible for unauthorized access to a Participant's Membership Card or unauthorized uses thereof. Membership Cards may not be transferred, sold, assigned or otherwise encumbered. Each Membership Card will have an associated Program account ("Program Account") at https://www.mlb.com/redsox/rewards for the management of such Membership Card and its associated Program benefits as described below.
Program Benefits.
Direct Authorization and eCash.
The Participant may link a credit card (the "Credit Card") to his or her Membership Card for permitted purchases at Fenway Park, including concessions and Red Sox Team Store Purchases, through his or her Program Account at https://www.mlb.com/redsox/rewards ("Direct Authorization" or "Fenway Pay"). Upon activating Direct Authorization on Participant's Membership Card, the Participant hereby authorizes the Club to charge the Credit Card for all purchases initiated using the Participant's Membership Card. The Participant hereby acknowledges and agrees that he or she is the authorized user of the Credit Card with permission to grant the rights set forth herein. The Participant may unlink or change the Credit Card associated with the Membership Card at any time through his or her Program Account. The Club is not responsible for purchases made using lost or stolen Membership Cards. It is the responsibility of the Participant to unlink his or her Credit Card from the Membership Card in the event of his or her Membership Card is lost or stolen.
Any payment funds previously transferred onto the Membership Card via the Program Account for electronic payment purposes ("eCash") may also be used for permitted purchases at Fenway Park, provided that no new funds may be transferred to the Membership Card by Participant in the form of eCash. It is the Participant's responsibility to ensure that adequate financial value remains on the Membership Card for any attempted permitted purchases at Fenway Park. The Club shall have no responsibility whatsoever with respect to any transactions between the Participant and its credit institution, and the Club hereby expressly disclaims all liability for any and all loss, damage or other harm, financial or otherwise (including interest, fees or other penalties) that may be incurred by the Participant in connection with any such transactions, whether or not such transactions relate in any way to the Program and/or the Membership Card.
eCash may not be withdrawn while the Participant is a season ticket holder of the Club unless required by applicable law. eCash balances remaining at the conclusion of a season, excluding any gifted or promotional eCash granted to Participant by the Club (which shall expire at the end of the applicable season), may be carried over for future season(s) for which the Participant is a season ticket holder of the Club or repaid to the Participant if no longer a season ticket holder as described below. Nothing in these Program Terms guarantees or creates any past, present or future rights in or interest to any season tickets or other tickets at Fenway Park. Any season ticket renewals and/or purchases are at the discretion of the Club. If at any time a Participant's season ticket account is cancelled or not renewed or if otherwise required by applicable law, the Club shall provide the Participant with payment by check within 6-8 weeks of such cancellation or nonrenewal in the amount equal to the stored eCash value on the Membership Card, excluding any gifted or promotional eCash granted to Participant by the Club.
Points and Rewards.
Participants acknowledge that Participant activities related to Boston Red Sox home and away games are tracked to accumulate rewards points ("Points"). An explanation of how Points may be earned and redeemed for certain rewards ("Rewards"), including a description of the Rewards and rules for transferring, retaining and forfeiting Points, may be found on https://www.mlb.com/redsox/rewards. Each Participant will earn and manage "Total Points" based on their own qualifying activities and they will each earn "Average Points" equal to the number of non-ticket points earned plus a flat 50 points per game if any ticket in a Participant's season ticket plan is scanned. See "Redeeming Points" in the "Learn More" section at https://www.mlb.com/redsox/rewards for more information.
Rewards may only be earned by accumulating the applicable Point value(s) specified on www.redsox.com/rewards. Points may not be used for any purpose other than to redeem Rewards. Points and Rewards cannot be redeemed for cash at any time, have no cash value at any time and cannot be combined with any other ticket or promotional offer of the Club or any third party. Points and Rewards may not be transferred (except as expressly set forth in the Program Terms), sold or assigned by any means, electronic or otherwise. The Club reserves the right to revoke and not honor any Rewards or Points for which attempts have been made to transfer, sell or assign. The Club is not responsible for Rewards lost, misdirected or delayed via mail or over email, nor does it guarantee timely Rewards delivery. The Club is not responsible for unauthorized Point redemption activity. The Points required to earn any Rewards is determined by the Club. The Club reserves the right at any time to change Point values associated with any Rewards; limit, modify or cancel any Rewards or the number and type of Rewards available; and change rules for earning, redeeming, retaining or forfeiting Points. Certain Rewards may only be awarded to Members that renew their season ticket plan for the following season, as described at https://www.mlb.com/redsox/rewards. If such a Reward is awarded to a Member and the Member does not subsequently renew his or her season ticket plan for the following season, the Club may revoke the Reward and provide a reward of equivalent value determined by the Club in its sole discretion.
Points may also be redeemed for certain items pursuant to auction(s) held at https://www.mlb.com/redsox/rewards (each, an "Auction"). Each Auction shall include a description of the item(s) available, a starting bid value, an incremental bid value, and redemption instructions. All bids shall be made in Points only. A Participant may not purchase additional Points. A Participant may not bid more Points than the number associated with his or her account. Each Auction begins at approximately 7:00 pm ET on a designated Wednesday, and ends at 12:00 pm ET on the following Wednesday (each, a "Bidding Window"); provided, that the Club reserves the right to alter the timing on any Auction at any time in the Club's sole discretion. Notwithstanding the foregoing, if a Participant makes a qualifying bid within the last three (3) minutes of a Bidding Window, the Bidding Window shall be automatically extended for three (3) additional minutes until no further qualifying bids are made within the last three (3) minutes of the Bidding Window. The Participant that places the highest bid during the Bidding Window shall be the winner of the Auction and shall be contacted with redemption instructions within five (5) business days of the closing of the Bidding Window. The number of Point the winning Participant bid during the Auction shall be deducted from his or her Program Account. If a Participant participates in an Auction but does not win, he or she shall retain all Points bid during the Auction. The Club is not responsible for unauthorized Auction activity. The Club reserves the right at any time to change Point values associated with any Auction and to limit, modify or cancel any Auctions or the number and type of items available for auction.
Additional Terms and Conditions.
Membership Cards, Points, and Rewards are not refundable, exchangeable, replaceable or transferable unless specifically permitted by these Program Terms. The Club is not responsible, and shall not be held liable, for misdirected Membership Cards, Points or Rewards and any unauthorized activities related to Membership Cards, Points or Rewards due to erroneous or outdated personal information in a Program Account. The Club is not responsible, and shall not be held liable, for any security breaches by any third party, including without limitation related to unauthorized activities related to the Program, Membership Cards, Points or Rewards. Participants are solely responsible for any tax liability arising out of earning or redeeming Points and the use of Rewards. Participants and their guests shall at all times abide by all applicable governmental laws, ordinances, orders, directions, rules and regulations, health and safety protocols, including but not limited to any masking, health check or vaccination requirements, and all Club policies, rules and regulations, including any resale price restrictions, smoking prohibitions and restrictions on entry to Fenway Park. The Club may refuse admission to, or eject from Fenway Park, any Membership Card holder without refund if the Membership Card holder fails to comply with any applicable Club policies applicable to conduct at Fenway Park (including health and safety protocols) or is deemed to be disorderly. Inappropriate behavior, abusive language, or interference with the play of the game may result in ejection from Fenway Park (without refund), arrest, forfeiture of ticket privileges and other legal action. In case of violation of applicable laws, regulations or the Program Terms, or fraud or abuse involving the Program, (i) the Club will have the right to take appropriate administrative and/or legal action, including but not limited to revocation/cancellation of Membership Cards, Points and Rewards and (ii) Participants will be liable for payment of all fines, penalties, costs, fees and any other monies owed pursuant to the Program Terms and any applicable law, including, without limitation, any such fines, penalties, liabilities, costs or fees incurred by the Club or its affiliates as result thereof. If any term of these Program Terms is held to be unlawful or unenforceable, then the Club and/or the Participant, as applicable, shall be relieved of such unlawful or unenforceable obligation and the remaining provisions will be enforced to the fullest extent permitted by law. Awarding of Rewards is void where prohibited by law.
As a condition to participating in the Program, each Participant agrees that any and all disputes, claims, controversies, or causes of action arising out of or relating to the Program or component thereof (each, a "Claim") shall be (i) arbitrated on an individual basis only and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party and (ii) settled by binding arbitration in Suffolk County, Massachusetts before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof. These Program Terms shall be governed by and construed and interpreted in accordance with the laws of the Commonwealth of Massachusetts, U.S.A, applicable to contracts entered into and performed exclusively in that Commonwealth.
THE CLUB, EACH OF ITS PARENT AND AFFILIATED ENTITIES, AND EACH OF THE MLB ENTITIES (AS DEFINED IN THETERMS OF USE AT https://www.mlb.com/official-information/terms-of-use), AND THEIR RESPECTIVE AGENTS, LICENSEES, VENDORS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, INDEPENDENT CONTRACTORS AND REPRESENTATIVES (COLLECTIVELY, THE "RELEASED PARTIES") WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ANY AND ALL PARTICIPANTS AND THEIR AUTHORIZED USERS AGAINST ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE OR EXEMPLARY DAMAGES) TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH OR CONTRACTION OF COMMUNICABLE DISEASES (INCLUDING COVID-19) OR PROPERTY, ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF A REWARD, AND/OR PARTICIPATING IN THE PROGRAM, PROGRAM-RELATED ACTIVITIES (INCLUDING WITHOUT LIMITATION PARTICIPATION IN THE ECASH FUNCTIONALITY) AND/OR REWARD-RELATED ACTIVITIES. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY REWARD CANNOT BE AWARDED FOR ANY REASON. IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DELAY IN OR FAILURE TO PERFORM DUE TO CAUSES BEYOND THE RELEASED PARTIES' CONTROL, INCLUDING, WITHOUT LIMITATION, ANY ACT OF GOD, ACT OF WAR, STRIKE, LOCKOUT, WORK STOPPAGE OR LABOR DISPUTE, NATURAL DISASTER, WEATHER, TERRORISM, OR ANY ACT OR OMISSION OF A THIRD PARTY. THE CLUB MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER REASON WITH RESPECT TO THE MEMBERSHIP CARDS, POINTS, REWARDS AND/OR THE PROGRAM.
