Cubs First Pitch Presale Access Program
Terms and ConditionsNo purchase or payment necessary to enter or participate in the 2022 Cubs First Pitch Presale Access Program ("Program"). You may enter the Program for the opportunity, subject to availability, to purchase a single game ticket to any Chicago Cubs 2022 regular season home game played at Wrigley Field (each, a "Game" and collectively, the "Games") prior to the day/time when single game tickets are sold to the general public. Registration for the Program begins at 8:00 a.m. Central Standard Time on March 11, 2022 and ends at 11:59 p.m. CDT on March 15, 2022 (“Registration Period”). Participants may enter the Program on the webpage www.mlb.com/cubs/tickets/first-pitch-presale. (“Program Site”). Void where prohibited or restricted by law.
The Cubs will conduct a random drawing from among eligible fans who successfully complete the registration form. Detailed information on eligibility, registration and the selection process is available below. You may enter the Program once. Winners are selected at random. These Terms and Conditions are applicable to the Program.
ELIGIBILITY: (1) you must be eighteen (18) years of age or older and a legal resident of one of the fifty (50) United States or the District of Columbia at the time of registration; (2) you must complete and submit the registration form during the Registration Period; (3) eligible registrants do not include any person who is deemed not in good standing with Cubs (as defined below) or has, for any reason, ever been denied entry to Wrigley Field for an entire Major League Baseball season, had a season ticket license revoked, or had a season ticket license not renewed by the Chicago Cubs Baseball Club, LLC (the "Cubs"). Federal, state and local laws and regulations apply.
HOW TO ENTER:
VIA WEBSITE: Registrants may register for the Program through the Program Site www.mlb.com/cubs/tickets/first-pitch-presale. Program participants registering via the Program Site may submit a registration as shown on the Program Site by completing all required fields and submitting the registration form during the Registration Period.
There is a limit of one (1) registration per person and the drawing winners will receive the opportunity, subject to availability, to purchase single game tickets to a Game(s). Use of automated devices or programs in connection with registering for the Program is prohibited. Proof of registrant's submission of information is not considered proof of receipt of such registration. Odds of being selected as a drawing winner depend on the number of eligible registrations received during the Registration Period and the total number of tickets available for purchase through. No registrations will be returned. Acknowledgment of any registration, if any, does not constitute confirmation or validity of registration. Multiple registrations by the same person is not permitted, and persons submitting multiple registrations and registrations utilizing disposable email addresses, will be disqualified. Incomplete registrations will be disqualified. The number of tickets to be sold through the Program shall be at the sole discretion of Cubs.
Registering does not guarantee any registrant the opportunity to purchase tickets.
NOTE: Major League Baseball game dates and times are determined in conjunction with the Office of the Commissioner of Baseball and/or the Cubs, as applicable, and may be subject to change. All tickets purchased in connection with the Program shall be subject to the terms thereon and those policies applicable to Cubs ticket holders generally; and may be amended from time to time.
This Program is subject to MLB's Terms of Use (accessible at mlb.com/tou) and Privacy Policy (accessible at mlb.com/privacy).
TICKET PURCHASE OPPORTUNITY: Drawing winners shall have the opportunity, subject to availability, to purchase a single game ticket to any Game(s) (the "Purchase Opportunity"). There is no monetary value to the Purchase Opportunity. No substitutions or cash redemption of the Purchase Opportunity is permitted. The Purchase Opportunity, and any ticket purchased by a drawing winner through the Program, is not assignable or transferable and may not be resold. The seat locations of tickets may be anywhere in Wrigley Field, as offered by the Cubs, and may have a partial, restricted, and/or obstructed view of the field. Drawing winners must purchase their tickets via payment card or other purchase method approved by Cubs and as directed in the drawing winner notifications. Once tickets are purchased, there are no refunds or exchanges, unless such Game is impacted as part of our Cubs Guarantee. Additional restrictions and conditions may apply.
DRAWING; CLAIMING PURCHASE OPPORTUNITY: The Cubs will conduct a random electronic drawing from among all eligible registrations. The drawing will take place on or around March 16, 2022. All registrants (those selected in the drawing and those who are not) who entered on the Program Site will be notified via email notification. If a registrant entered on the Program Site and provided a valid US mobile phone number on the registration form and consented on the registration form to receiving Program-related texts, she/he/they may also receive notification via SMS text message. The drawing winner's notification email or text will include instructions on how to purchase tickets with a valid payment card or other purchase method approved by Cubs. Tickets will be delivered via the App, and barcodes will be enabled four (4) hours prior to Game time. Only the person who entered the Program and was selected as a drawing winner may redeem the Purchase Opportunity and purchase tickets to a Game(s). Unclaimed tickets (i.e., tickets not purchased within the time period specified in the notification email will be released and a Purchase Opportunity may be offered to another registrant selected by random drawing from among all remaining eligible registrations or the tickets may be sold to the general public or used by Cubs for any purpose. The drawing will be conducted by Cubs, whose decision is final and binding on all aspects of the Program.
Failure of a drawing winner to respond as referred to above may result in disqualification and the selection of another registrant by random drawing from among all remaining eligible registrations received, at the Cubs sole discretion and time permitting.
By registering for the Program, each registrant agrees to be bound by these Terms and Conditions and by all decisions of Cubs, and to comply with all federal, state and local laws and regulations, as well as rules of Wrigley Field and any terms and conditions printed on the back of any ticket purchased (collectively, "Wrigley Field Conditions"). In the event of a registrant's or drawing winner's noncompliance or demonstrated intent not to comply with these Terms and Conditions, applicable laws or any Wrigley Field Conditions (including, without limitation, a drawing winner's resale of a ticket purchased through the Program) for any reason, or such registrant or drawing winner's inability to accept the Purchase Opportunity for any reason, his/her registration may be disqualified and/or the Purchase Opportunity and/or any ticket purchased by a drawing winner through the Program may be revoked in Cubs' sole discretion.
Registrations generated by a script, macro, or other mechanical or automated means will not be valid. Neither MLB Advanced Media, L.P. (“MLB”), the Cubs nor any other MLB Entity (defined below) is responsible for late, incomplete, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, or garbled registrations, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; any error, omission, interruption, defect or delay in transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these terms and conditions, in any advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with this Program, including, without limitation, errors or difficulties which may occur in connection with the administration, the processing of registrations, or the cancellation or postponement of any Major League Baseball game, event or exhibition. No MLB Entity is responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in connection with this Program. No MLB Entity is responsible for injury or damage to registrants' or to any other person's computer related to or resulting from participating in this Program or downloading materials from or use of the Program Site or App. Persons who tamper with or abuse any aspect of this Program, the Program Site, the App or any other website associated with the Program or attempt to undermine the legitimate operation of the Program by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other registrant or any representative of Cubs, MLB or any other MLB Entity or who are in violation of these Terms and Conditions, as solely determined by the Cubs, will be disqualified and all associated registrations will be void. Any attempt to deliberately damage the content or operation of this Program or any website associated with the Program or the App is unlawful and subject to legal action by the Cubs, MLB or their respective agents. The Cubs shall have the sole right to disqualify any registrant for violation of these Terms and Conditions or any applicable laws relating to the Program, and to resolve all disputes in its sole discretion. The MLB Entities make no warranty, guaranty or representation of any kind concerning any Purchase Opportunity, and (ii) disclaim any implied warranty.
By registering for the Program, each registrant releases and holds harmless the Cubs, MLB, the other MLB Entities, Apple, Inc., and each of their respective affiliates, parents, subsidiaries, lenders, advertisers, promotional agencies, directors, members, successors, sponsors, partners, licensees, officers, agents, employees, advisors, successors and assignees, and each individual or entity associated with the development and execution of the Program, from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from (a) any failure of a drawing to be conducted for any reason; (b) the actions of registrants or any other individuals in connection with any drawing; (c) injury or damage to such registrant's or other individual's computer(s), mobile device(s), or other equipment as a result of participation in the Program; (d) any loss or disclosure of registration or App registration data; (e) any participation in any Purchase Opportunity-related activity; or (f) acceptance, possession, use, or misuse of any Purchase Opportunity awarded in connection with any drawing, including without limitation claims based on negligence, breach of contract or liability for physical injury, death, or property damage.
Without limiting the terms herein, by registering for the Program each registrant agrees that to the extent permitted by applicable law: (1) any and all disputes, claims and causes of action arising out of or in connection with the Program, whether between such registrant and Cubs or MLB or any other MLB Entity, will be resolved individually, without resort to any form of class action, and no such dispute, claim or cause of action may be brought in a purported representative capacity on behalf of the general public or persons similarly situated; (2) under no circumstances will any registrant be permitted to obtain any award for, and registrant hereby knowingly and expressly waives all rights to seek, punitive, incidental, exemplary, consequential or special damages; lost revenues and/or lost profits; and (3) registrant irrevocably waives any right to seek injunctive or equitable relief. These Terms and Conditions are governed by and shall be construed in accordance with the laws of the State of Illinois (without regard to conflicts of law principles). If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.
The “MLB Entities” as used herein shall mean the Cubs and the other Major League Baseball Clubs (“Clubs”), MLB Advanced Media, L.P. (“MLB”), the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.
