The following describes the Official Sweepstakes Rules for the “2024 Sonic Slam Inning Sweepstakes” (“the Sweepstakes”). Sweepstakes entrants must be eligible and qualify to win by satisfying the terms, requirements and conditions set forth below:
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. OPEN TO LEGAL RESIDENTS OF THE STATES OF AR, KS, NE, IA, OK, AND THE STATE OF MO EXCEPT THE COUNTIES OF CRAWFORD, DENT, FRANKLIN, GASCONADE, IRON, JEFFERSON, LINCOLN, MADISON, PERRY, PIKE, REYNOLDS, ST. CHARLES, ST. FRANCOIS, ST. LOUIS, ST. GENEVIEVE, WARRAN, AND WASHINGTON AND EXCEPT THE CITY OF ST. LOUIS, MO (COLLECTIVELY, THE "Royals Home TV Territory") WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF THE DATE THEY ENTER.
2. SPONSORS: Sponsors of the Sweepstakes are the Kansas City Royals® Baseball Club, LLC (“Kansas City Royals”) One Royal Way, Kansas City, MO 64129 and Sonic Kansas City Advertising (together “the Sponsors”). “Sponsors and their designees or agents” shall mean Sponsors, their advertising/promotional and/or fulfillment agencies, their respective parent companies, affiliates, subsidiaries, franchisees, and their respective employees, officers, directors and agents. The fulfillment of the Sweepstakes will be administered by the advertising/promotional and/or fulfillment agencies that have been retained by the Sponsors (the "Administrators").
3. ELIGIBILITY: The Sweepstakes is open to legal residents of the Royals Home TV Territory (defined above) who enter the Sweepstakes as indicated below and are eighteen (18) years of age or older as of the date they enter. Limit of one (1) winner per household. Void outside the Royals Home TV Territory and where prohibited or restricted by law, rule or regulation. The Sweepstakes is subject to all applicable federal, state and local laws. Employees of Sponsors, Administrators, the other MLB Entities (defined below) and their designees or agents or their parent companies, affiliates, subsidiaries, divisions, franchisees, and their advertising and promotional agencies and their respective officers, directors and agents (collectively, the “Sweepstakes Entities”) and the immediate family members and persons living in the same household of each are not eligible to enter or win. Participation constitutes entrant’s full and unconditional agreement to these Official Sweepstakes Rules and Sponsors’ decisions and interpretations, which are final and binding in all matters related to the Sweepstakes. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.
4. SWEEPSTAKES PERIOD: The Sweepstakes begins at 12:00 PM Central Time ("CT") on March 28, 2024 and ends at the conclusion of the Kansas City Royals regular 2024 MLB season or 11:59 PM CT on September 29, 2024, whichever comes first (the "Sweepstakes Period"). The clock of the applicable Administrator is the Sweepstakes official clock. If MLB and/or the Kansas City Royals end the 2024 season early, such end date will be the end of the Sweepstakes Period. Neither the Kansas City Royals nor the Sweepstakes Entities guarantee any specific number of games during the Sweepstakes Period.
5. HOW TO ENTER: You may enter the Sweepstakes by visiting https://www.mlb.com/royals/forms/2024-sonic-slam-sweeps or by clicking on the corresponding link in the MLB Ballpark App which redirects to the royals.com online form. No other method of entry will be accepted. Limit one (1) entry per person/email address/household. Additional entries beyond the specified limit will be void.
During the Entry Period visit the App Store or Google Play on your mobile device and download the MLB Ballpark App. You must sign up for an MLB account to use the MLB Ballpark App but there is no cost to use the app. Once you have accessed the MLB Ballpark App, navigate to the KC Royals page and look for the Sonic Slam Sweepstakes under Offers & Promos. Click on the Sonic Slam Sweepstakes button to access the entry form for the Sweepstakes. By successfully transmitting a completed entry form through the MLB Ballpark App as directed, you will be entered in the Sweepstakes. All information submitted online by entrants is subject to, and will be treated in a manner consistent with, Major League Baseball’s Terms of Use accessible at: mlb.com/tou and Privacy Policy accessible at: mlb.com/privacy. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Incomplete and/or inaccurate entries are void. Entrants to the Sweepstakes may be given the option to receive (a) commercial email from Sponsors and/or MLB and/or (b) mobile text messages and updates from Kansas City Royals or MLB; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s consent to receive such emails and/or mobile text messages and updates and consenting to receive such emails and/or mobile text messages and updates will not impact any entrant’s chances of winning. Standard messaging rates apply to mobile text messages and updates. Check with your mobile service provider for more information.
No automated, photocopied or mass-produced entries are permitted. All entries become the sole and exclusive property of the Sponsors and receipt of entries will not be acknowledged or returned. Delivery of prizes requires a street address. Sponsors and MLB Entities are not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, postage-due, misdirected, or garbled entries, which will be disqualified, or for problems of any kind whether mechanical, human or electronic. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsors.
By entering, entrants agree to comply with these Official Sweepstakes Rules including all eligibility requirements. Illegible and/or incomplete entries and entries submitted by entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Sponsors, MLB, and their designees or agents are not responsible for lost, late, mutilated, illegible, misdirected, mis-delivered, stolen, incorrect or incomplete entries or any error which may occur in the receipt or processing of the entries. Entrants assume all risks of the same. Sponsors, MLB, and their designees or agents reserve the right to modify the scheduling of the Sweepstakes without prior notification. All entries become the sole property of the Sponsors and their designees or agents and will not be acknowledged or returned.
6. WINNER SELECTION AND NOTIFICATION: Sonic Slam Inning potential winners will be selected from random drawings held by an Administrator from all eligible entries received throughout the 2024 Kansas City Royals baseball season during the Sweepstakes Period. The maximum number of winners is one per game during the Sweepstakes Period for a maximum of 162. Each randomly drawn eligible Sonic Slam Inning winner whose name is selected will be announced prior to the Royals’ half of the sixth inning of each Kansas City Royals 2024 home game (each, a “Sonic Slam Inning”). Such announcement may be made over the internet or social media and the individual will be notified by telephone or email. If a Kansas City Royals baseball player hits an over-the-wall home run during the Sonic Slam Inning, that game’s Sonic Slam Inning selected winner will win a minimum of $100. Inside the park home runs are excluded. If no over-the-wall home run is hit during the Sonic Slam Inning by a Kansas City Royals baseball player, then the selected winner receives game tickets and dinner only (see Section 7) and the minimum award of $100 carries over to the next broadcast game and serves to increase the minimum award by $100. The minimum Sonic Slam Inning home run award amount builds by $100 for every broadcast game that an over-the-wall home run is not hit by a Kansas City Royals baseball player during the Sonic Slam Inning. For example, if an over-the wall home run is not hit by a Kansas City Royals baseball player during the Sonic Slam Inning in a broadcast game, then the minimum award for the Sonic Slam Inning during the next broadcast game will be $200 (instead of $100). Once one home run prize for a Sonic Slam Inning over-the-wall home run hit by a Kansas City Royals player has been awarded to the randomly drawn Sonic Slam Inning winner, the winner continues to win $100 (regardless of the dollar amount of the first over-the-wall home run hit during the Sonic Slam Inning) with each additional over-the-wall home run hit by a Kansas City Royals player in that game’s sixth inning for the Sonic Slam Inning Sweepstakes. If a Kansas City Royals player hits an over-the-wall grand slam (four-run home run) in the Sonic Slam Inning) the randomly drawn Sonic Slam Inning winner for that broadcast game will be awarded a grand prize of $25,000. Sponsors’ designees or agents are responsible for notifying winners and will make reasonable efforts to notify winners within approximately thirty (30) days from the date an entrant wins any prize. Potential winners are subject to verification of eligibility and compliance with these Official Sweepstakes Rules within ten (10) days of notification. Failure to provide any required information within such ten (10) day period may result in forfeiture of winner’s right to claim a prize and may result in the prize being awarded to an alternate winner, if time permits. Upon verification of eligibility, each prize will be mailed to the winner at the physical address (P.O. Boxes are not permitted) provided during winner verification. The Sweepstakes Entities will not be held responsible for any delays in awarding a prize for any reason. If a potential winner is found to be ineligible, is not in compliance with these Official Sweepstakes Rules, declines to accept a prize, or any winner notification is returned as undeliverable or the potential winner fails to respond to a winner notification within ten (10) days of receipt, or if a potential winner does not answer the initial telephone notification, the prize may be forfeited. If a prize, is forfeited for any reason, it may be added to the Sonic Slam Inning home run prize for the next broadcast game.
7. PRIZES AND ODDS OF WINNING: Each winner whose name is randomly selected for the Sonic Slam Inning will win two (2) tickets for winner and one (1) guest for one (1) 2024 Kansas City Royals home game (as determined by the Kansas City Royals) and dinner for winner and his/her guest at a participating Sonic Drive-In up to a maximum of $45. Actual value of the tickets and dinner portion of the prizes is approximately $45.00. The value of the Sonic Slam Inning home run portion of the prize depends on the dollar amount at stake at the time using the process in Section 5 of these Official Sweepstakes Rules.: A grand prize is awarded when a Royals player hits an over the wall grand slam during the Sonic Slam Inning. A grand prize consists of an award of $25,000.00 which will be paid by check or wire transfer at the discretion of Sponsors. Approximate Retail Value (“ARV”): $25,000. Odds of winning any prize depends on the total number of eligible entries received and/or the batting ability of Kansas City Royals baseball players.
8. PRIZE CONDITIONS: Prizes will be issued by the Kansas City Royals and participating Sonic Drive-Ins in the greater Kansas City, MO and St. Joseph, MO area. Section and specifics of the tickets and meals to be awarded will be determined by the Sponsors and their designees or agents. All prizes to be awarded are subject to availability. TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED. Seat locations at the game and, unless stated otherwise in the ‘Prizes and Odds of Winning’ Section, exact game/event/exhibition date shall be determined in the sole discretion of Sponsors. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see royals.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsors. Each winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize. Sponsors and the other MLB Entities reserve the right to remove or to deny entry to any winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Sweepstakes Entities will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to each winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities. All prizes to be awarded are awarded “AS IS” and without WARRANTY OF ANY KIND, express or implied (including without limitation, any implied warranty of merchantability or fitness for a particular purpose). Sponsors and their designees or agents are not responsible for and will not replace any lost or stolen tickets, checks or any grand prize payments. All prizes must be claimed no later than 10/10/2024 from the Kansas City Royals. All prizes are non-transferable and non-assignable. No other prize or cash substitutions will be made. Prizes unclaimed after 10/10/2024 will be forfeited.
9. TAXES AND COSTS RELATED TO PRIZES: All applicable taxes, including all federal, state, local and other taxes and any license, destination and delivery charges are the sole responsibility of all prize winners. The winners will be issued a 1099 tax form for the actual value of any prize and may be required to complete additional forms such as an IRS Form W-9. Taxes will be withheld from any prize in excess of $600.
10. GENERAL CONDITIONS: By participating in this Sweepstakes, participants agree: (a) to be bound by these Official Sweepstakes Rules, the decisions of the Sponsors, the other MLB Entities and the Administrators which are final; (b) to release and hold harmless Sponsors and their designees or agents, the Sweepstakes Entities and their respective franchisees, affiliates, employees and agents from any and all claims, demands, damages, losses, liabilities, costs or expenses, (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)) caused by, arising out of, or related to their participation in the Sweepstakes; acceptance, possession, or use of any prize awarded including a grand prize; and/or their participation in any prize-related activities including, without limitation, any virus exposure while receiving a prize; and (c) to be contacted by Sponsors and/or Administrators via mail, e-mail, and telephone. By accepting any prize including a grand prize, the prize winners consent to the use of each winner’s name and/or likeness (including his/her voice, biographical information, city and state of residence, statements, photograph, etc.) by Sponsors for advertising and promotional purposes without additional compensation (except if a grand prize winner is a resident of TN or where prohibited by law). Sweepstakes entrants and winners acknowledge that they must sign an Affidavit of Eligibility and (where legal) Publicity Release prior to the acceptance of a prize as a condition to receiving any such prize. An entrant’s entry constitutes permission to announce on the Royals Radio and/or TV Network broadcasts prior to the Royals half of the sixth inning of the game that the person was selected as Sonic Slam Inning entrant and a potential winner. Sponsors, MLB, and their designees or agents reserve the right to make changes, modifications or additions to these Official Sweepstakes Rules and/or extend and/or modify the dates of this Sweepstakes for any reason at any time. Any such changes, modifications or additions to the Official Sweepstakes Rules will become effective upon written amendment or announcement. Any failure by Sponsors and their designees or agents to enforce any term of these Official Sweepstakes Rules shall not constitute a waiver of any such provision.
11. DISPUTES: All entrants and Sponsors (together the “Parties”) agree that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved in the following manner: (a) Negotiation - The Parties first shall use reasonable efforts to discuss and negotiate a resolution of the controversy; (b) Arbitration. If the efforts to negotiate a resolution do not succeed, the Parties shall resolve the controversy by final and binding arbitration in accordance with the Rules for Commercial Arbitration of the American Arbitration Association (the “Rules”) and pursuant to the following additional provisions; (c) Applicable Law - The Parties agree that the internal laws of Oklahoma shall govern the construction of the terms and the application of the provisions of the Sweepstakes and that all disputes will be resolved in accordance with Oklahoma law; (2) Selection of Arbitrators - The Parties shall select one arbitrator within ten (10) days after the filing of a demand and submission in accordance with the Rules. If the Parties fail to agree on an arbitrator within that ten (10)-day period or fail to agree to an extension of that period, the arbitration shall take place before an arbitrator selected in accordance the Rules; (3) Location of Arbitration. The arbitration shall take place in Oklahoma City, Oklahoma, and the arbitrator shall issue any award at the place of arbitration. The arbitrator may conduct hearings and meetings at any other place agreeable to the Parties or, upon the motion of a party, determined by the arbitrator as necessary to obtain significant testimony or evidence; (4) Enforcement of Award - The prevailing party shall have the right to enter the award of the arbitrator in any court having jurisdiction over one or more of the Parties or their assets. The Parties specifically waive any right they may have to apply to any court for relief from any decision of the arbitrator made prior to the award; (5) Attorneys’ Fees and Costs - The prevailing party to the arbitration shall have the right to an award of its reasonable attorneys’ fees, costs, and expenses incurred after the filing of the demand and submission.
12. LIMITATION OF LIABILITY/GOVERNING LAW. All entrants agree that by entering the Sweepstakes they waive any and all rights to claim actual, punitive, incidental, and consequential damages, and any other damages, against Sponsors and their designees or agents. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, or the rights and obligations of entrants and the Sponsors and their designees or agents in connection with this Sweepstakes shall be governed by, and construed in accordance with the laws of the State of Oklahoma, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Oklahoma or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of Oklahoma. WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
13. RULES: Official Sweepstakes Rules are available at all participating Sonic Drive-Ins in the Kansas City, MO and St. Joseph, MO area or by mailing a self-addressed stamped envelope to: SONIC® SLAM, P.O. Box 419969, Kansas City, MO 64141.
14. WINNER’S LIST: For a winner’s list, send a self-addressed stamped envelope no later than October 31, 2024 to: Winner's List - SONIC® SLAM, P.O. Box 419969, Kansas City, MO 64141.
