Texas Rangers Risk It (“Risk It”)

1. SPONSOR.Texas Rangers Risk It (“Risk It”) is presented by The Choctaw Nation of Oklahoma, a federally recognized Indian tribe d/b/a Choctaw Casino & Resort (the “Sponsor”), located at 4216 S. Hwy 69/75, Durant, Oklahoma 74701.
2. ELIGIBILITY. Risk It is open to legal residents of the United States who, at the time of entry are at least twenty-one (21) years of age or older. Employees and officers of Sponsor, the MLB Entities (defined below), and each of their respective parent companies, subsidiaries, affiliates, advertising agencies, authorized dealers, promotional suppliers, and prize providers (collectively, “Risk It Entities”) and the immediate family members (spouses, parents, children, and siblings and their spouses) or members of the same household (whether related or not) of such individuals are not eligible to enter or win. Void where prohibited. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees, and agents of the foregoing entities.
3. ENTRY PERIOD. The Risk It period will begin at the official start of the Texas Rangers Game (defined below) played on or after May 15, 2023, and will end on October 1, 2023 (the “Risk It Period”), with each Texas Rangers Game serving as separate entry periods (each, an “Entry Period”).

Each Texas Rangers Game during the applicable Entry Period begins at the official start of each Texas Rangers Game and ending at the end of such game. The term “Texas Rangers Game” means a MLB game of the Texas Rangers in which the Texas Rangers are the home team playing at Globe Life Field, located at 734 Stadium Drive, Arlington, Texas 76011 (the “Stadium”), beginning at the official start of such game and ending at the official end of such game, as such official start and end times are determined by MLB. You can play Risk It during Texas Rangers Games played during each Entry Period using your personal mobile device to select your answer predicting the number of times certain event(s) will occur during the applicable Game (each, a “Game Event”). You will earn Game Event Points (as defined below) for each Game you play Risk It during the applicable Entry Period and your total Game Event Points for the applicable Entry Period will be tabulated by Sponsor on or about the first calendar day following the end of that Entry Period.

4. HOW TO PARTICIPATE. To participate, you must download the MLB Ballpark application available on the Apple App Store and Google Play (the “Application”) to your personal mobile device. Once the Application is downloaded to your personal device, you must navigate to the Texas Rangers page, and click on the “Texas Rangers Risk It” button to participate. Mobile data rates may apply. Check with your mobile service provider for more information.

Once you've clicked on "Risk It," you will simply select your desired answer to each Game Event question and allocate the number of Game Points (as defined below) that you are willing to risk on your selected answer being correct. You will start the game with a total of five hundred (500) points to allocate to your answers for the Game Event questions (“Game Event Points”). Your allocation of the Game Event Points may range from zero (0) to one hundred seventy five (175) for any single question. For each question correctly answered, you will earn the number of Game Event Points allocated to that question. Your Game Event Points total for the applicable Game will appear on your fan dashboard of the Application as soon as the correct answers are uploaded by Sponsor and Risk It is closed, which will occur within an hour following the final out of the applicable Game. At the conclusion of each Entry Period, Sponsor will tabulate the total of all Game Event Points earned by each participant during the applicable Entry Period to determine the participant with the highest total number of Game Event Points earned during that Entry Period (a “Top Score”). In the event of a tie or multiple ties in the highest total number of Game Event Points earned by participants during the applicable Entry Period, then the Top Score will be selected based on the average time of entry into the Application (i.e., among all participants tied for the highest Game Event Points, the participant with the Top Score will be determined based on the actual time, as reflected in the electronic records, the participant clicked or tapped on "Submit" for the applicable Entry Period). NO GAME EVENT POINTS WILL BE RECORDED AFTER THE CORRECT ANSWERS TO THE QUESTIONS ARE UPLOADED AND THE IN-STADIUM GAME CLOSED, WHICH WILL OCCUR SHORTLY FOLLOWING THE FINAL OUT OF EACH GAME DURING THE APPLICABLE ENTRY PERIOD.

You may participate in Risk It only via the Application using your mobile device. No other method of entry will be accepted. Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to use the Application. Use of the Application to participate in Risk It is subject to, and will be treated in a manner consistent with, Major League Baseball’s website (MLB.com) Terms of Use accessible at: https://www.mlb.com/apps/ballpark and https://www.mlb.com/official-information/terms-of-use.

5. TOP SCORES AND ODDS: On or about the first calendar day following the end of each Entry Period, the participant with the Top Score for the applicable Entry Period will be determined by Sponsor. Subject to verification of eligibility and compliance with these Official Rules, the potential winner with the Top Score will be declared the official Top Score winner for that Entry Period. The odds of winning the prize for a Top Score are based upon (a) the number of participants playing the In-Stadium Game during the applicable Entry Period and (b) the total number of Game Event Points earned by a participant during the applicable Entry Period.
6. PRIZES, PRIZE CONDITIONS AND ODDS. Prizes will be awarded per Entry Period as set forth below (each, a “Prize” and collectively, the “Prizes”).

Top Score Prize: One (1) Prize will be awarded each Entry Period to each of the top five (5) scoring participants (each, a “Top Score Prize”). Each Top Score Prize Winner will receive (i) a One Hundred Dollar ($100) play card for gaming at Choctaw Casino & Resort – Durant, located at 4216 S. Hwy 69/75, Durant, Oklahoma 74701 (the “Venue”), which shall be subject to the rules and conditions on the free play card and those of the Venue, and (ii) a Texas Rangers mini pennant. The approximate retail value (“ARV”) of each Top Score Prize: $103.

7. WINNER SELECTION AND NOTIFICATION. Each potential winner will be notified at the email address associated with the potential winner’s Application account with details on how to collect the prize (the "Prize Notification"). Each entrant is responsible for monitoring his/her email for prize notification and receipt of other communications related to Risk It. If a potential winner does not claim his/her Prize during the time frame noted in the prize notification, as applicable, that potential winner forfeits his/her Prize and the Prize will go unawarded. Upon request of Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form in a form provided by Sponsor. If a potential winner fails to comply with these Official Rules, that potential winner will be disqualified.

In no event will Sponsor be required to award more than the number of prizes stated in these Official Rules. Potential Winners of Prizes may be required to be physically present to claim a prize at a location specified by the Sponsor. Potential winners may not collect Prizes via telephone, Internet, mail or any other method in lieu of collection in person. In no event will Sponsor be required to mail or otherwise distribute Prizes to potential winners who cannot or do not claim the applicable Prize in person, on time, and in the manner described in the prize notification.

8. CONDITIONS OF PARTICIPATION. Risk It is subject to all federal, state, and local laws and regulations and is void where prohibited. All other expenses on the receipt and use of a Prize not specifically mentioned in these Official Rules are solely the responsibility of each individual Winner. By participating in Risk It, each entrant, agrees (a) to accept and abide by these Official Rules and terms of use of the Application, (b) that any dispute with regard to the conduct of Risk It, rule interpretation or award of Prizes shall be submitted to the management of Sponsor, who will make a final, binding determination, and (c) to waive any and all claims against the Risk It Entities, Sideline Sports, Inc., Apple, Inc., and the licensees, distributors, dealers, retailers, printers, representatives, and advertising and promotion agencies, and any and all other companies associated with the foregoing entities (collectively, “Released Parties”) for any injury, damage, or loss of any kind that may occur, directly or indirectly, in whole or in part, from participation in the game or from receipt or use of any Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)). Each Winner, by acceptance of a Prize, grants to MLB and Sponsor and each of their respective designees the right to publicize his/her name, address (city and state of residence), photograph, voice, statements, and/or other likeness and prize information for advertising, promotional, and/or trade and/or any other purpose (“Winner Information”) in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission, or notification, unless prohibited by law. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

As a condition of participating in Risk It, each participant agrees that (i) any and all disputes, claims, controversies or causes of action arising out of or relating to Risk It, or any Prizes awarded (each, a “Claim”), shall be (1) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (2) settled by binding arbitration in the City or County of St. Louis, Missouri, before a single arbitrator appointed by the American Arbitration Association in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (ii) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of Missouri, U.S.A, applicable to contracts entered into and performed exclusively in that State.

9. DISQUALIFICATION. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual suspected of tampering with the entry process or the operation of Risk It; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten, or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH RISK IT OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF RISK IT MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY PARTICIPANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, MLB AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

10. RISK IT ADMINISTRATION. Sponsor will be responsible for resolving any disputes and rules violations that arise in connection with Risk It. All decisions by Sponsor regarding Risk It shall be final and binding in all respects.
11. LIMITATION OF LIABILITY. Released Parties assume no responsibility or liability for (a) any incorrect or inaccurate registration or entry information, or for any faulty, failed, garbled, or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction, or alteration of entries at any point in the operation of Risk It; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation, or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilized in any aspect of the operation of Risk It; (d) inaccessibility or unavailability of the Internet, the Application, or any combination thereof; or (e) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in Risk It or download any materials in Risk It. If, for any reason, Risk It is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity, or proper conduct of Risk It, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend Risk It in whole or in part.
12. USE OF INFORMATION. Personally identifiable information that is submitted by entrants, as part of Risk It will be used to administer Risk It, select the Prize Winners and fulfill the Prizes.
13. WINNERS’ LIST. A record of the Winners and the odds of winning will be kept on file by Sponsor for a period of one (1) year following the last game played at Globe Life Field during the 2023 season.
