Impacted Game Bonus Terms and Conditions

1. Impacted Game Bonus:

New York Yankees Season Ticket Licensees, Group Ticket Purchasers and Individual Game Suite Purchasers (each, sometimes referred to as a “Licensee”) may be eligible to receive a Ten Percent (10%) bonus based on the Licensee’s “Impacted Game Credit” (as defined in the New York Yankees 2020 Ticket Policies for Impacted Games) up to a maximum of $25,000.00 per Licensee (“Impacted Game Bonus”), which can be applied only as described below. Any Licensee that receives any refund with respect to Impacted Game tickets and/or whose 2020 ticket account reflects an unpaid balance will not be eligible for any Impacted Game Bonus. Any ticket purchased with any Impacted Game Credit and/or Impacted Game Bonus is not subject to refund and will be subject to the Rain Check Policy.

2. Impacted Game Bonus for Season Ticket Licensees:

(a) Season Ticket Licensees who use their entire Impacted Game Credit only for the purchase and use of: (i) ticket(s) for another New York Yankees regular season home game(s) through the end of the 2021 regular season, subject to availability; (ii) the renewal of their 2021 season ticket plans; and/or (iii) tickets in accordance with the Rain Check Policy through the end of the 2021 regular season, subject to availability, will receive an Impacted Game Bonus equal to Ten Percent (10%) of their entire Impacted Game Credit up to a maximum of $25,000.00 per Licensee. For example, if a Season Ticket Licensee’s entire Impacted Game Credit equals $10,000.00 and the Season Ticket Licensee uses the entire Impacted Game Credit only for the purposes described herein, the Season Ticket Licensee will receive an Impacted Game Bonus discount of $1,000.00.

(b) The Impacted Game Credit must be used in its entirety as provided in subsection 2(a), above, before the Season Ticket Licensee is eligible for the Impacted Game Bonus.

(c) The Impacted Game Bonus can be applied as: (i) a discount towards the cost of the 2021 regular season ticket plan renewal; or (ii) an upgrade of the 2021 regular season ticket plan.

(d) The Impacted Game Credit will be applied first and the Impacted Game Bonus will be applied next to pay the outstanding balance of the 2021 season ticket plan renewal or upgrade (as applicable). The Season Ticket Licensees will be responsible for any outstanding balance for the 2021 season ticket plan renewal or upgrade.

(e) Any excess Impacted Game Bonus can be applied towards: (i) ticket(s) for another New York Yankees regular season home game(s) through the end of the 2021 regular season, subject to availability; or (ii) tickets in accordance with the Rain Check Policy through the end of the 2021 regular season, subject to availability; provided, any unused or unapplied Impacted Game Bonus shall automatically expire on July 1, 2021.

(f) Please note that if no action is taken by the Season Ticket Licensee, the Impacted Game Credit will be applied automatically towards the renewal of the 2021 season ticket plan as follows: (i) 50 percent on October 1, 2020; and (ii) the remaining balance on November 2, 2020.

3. Impacted Game Bonus for Group Tickets and Individual Game Suite Purchasers:

(a) Group Tickets Purchasers and Individual Game Suite Purchasers who use their entire Impacted Game Credit only for the purchase and use of: (i) ticket(s) for another New York Yankees regular season home game through the end of the 2021 regular season, subject to availability; and/or (ii) tickets in accordance with the Rain Check Policy through the end of the 2021 regular season, subject to availability, will receive an Impacted Game Bonus equal to Ten Percent (10%) of their entire Impacted Game Credit up to a maximum of $25,000.00. For example, if a Group Tickets Purchaser’s entire Impacted Game Credit equals $10,000.00 and the Group Ticket Purchaser uses the entire Impacted Game Credit only for the purposes described herein, the Group Tickets Purchaser will receive an Impacted Game Bonus discount of $1,000.00.

(b) The Impacted Game Credit must be used in its entirety as provided in subsection 3(a), above, before a Licensee is eligible for the Impacted Game Bonus.

(c) The Impacted Game Bonus can be applied as: (i) a discount towards the cost of a separate purchase of Individual Game Tickets, Group Tickets or an Individual Game Suite(s) during the 2021 regular season, subject to availability; and/or (ii) an upgrade of their Group Tickets or Individual Game Suite (as applicable) during the 2021 regular season, subject to availability.

(d) The Impacted Game Credit will be applied first and the Impacted Game Bonus will be applied next to pay the outstanding balance of: (i) ticket(s) (including upgrades) for another New York Yankees regular season home game through the end of the 2021 regular season, subject to availability; and/or (ii) tickets in accordance with the Rain Check Policy through the end of the 2021 regular season, subject to availability. The relevant Licensees will be responsible for any outstanding balance for tickets purchased.

4. Additional Impacted Game Bonus Terms and Conditions:

(a) Licensee’s 2020 ticket account must be in good standing (e.g., ticket account paid in full on or before March 26, 2020, no refunds for any Impacted Game tickets, no unpaid balance) in order to be eligible for the Impacted Game Credit and corresponding Impacted Game Bonus. Exceptions apply. Please contact your New York Yankees ticket representative to determine if your ticket account is in good standing and other details and information.

(b) If a Licensee has applied the entire Impacted Game Credit towards the purchase of New York Yankees 2021 regular season home game tickets no later than January 31, 2021, the Licensee will be entitled to receive a Impacted Game Bonus equal to ten percent (10%) of the Licensee’s Impacted Game Credit up to a maximum of $25,000.00 as determined and calculated by the New York Yankees. The Impacted Game Credit will expire on January 31, 2021 and any unused and/or unapplied Impacted Game Credit will be subject to the Rain Check Policy and will not be eligible for any refund.

(d) The Impacted Game Bonus has no cash value, is not redeemable for cash, non-transferable, non-refundable, cannot be sold or offered as a gift and cannot be combined with any other offer.

(e) The Impacted Game Bonus must be applied no later than July 1, 2021. Any unused or unapplied Impacted Game Bonus shall automatically expire on July 1, 2021.

(f) Except as set forth herein, the terms and conditions in the Licensee’s agreement(s) governing Licensee’s tickets apply. The New York Yankees reserve the right to modify, alter and/or amend these terms and conditions and/or terminate the Impacted Game Bonus at any time and without notice. Additional terms and conditions apply.

For All Ticket Purchases:

IN NO EVENT WILL THE NEW YORK YANKEES BE LIABLE TO LICENSEES, TICKET HOLDERS AND/OR TICKET PURCHASERS FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR FOR LOST PROFITS, REVENUES OR BUSINESS OPPORTUNITIES EVEN IF THE NEW YORK YANKEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSEE AGREES THAT ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THE IMPACTED GAME CREDIT AND/OR THE IMPACTED GAME BONUS SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION HELD IN NEW YORK, NEW YORK. LICENSEE AND THE NEW YORK YANKEES SHALL NOT BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER INDIVIDUALS OR ENTITIES, OR ARBITRATE AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.
