NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS AGREEMENT COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF RELEASED PARTIES (DEFINED BELOW) USE REASONABLE CARE IN PROVIDING THE EVENT (DEFINED BELOW), THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY ATTENDING THE EVENT BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE EVENT WHICH CANNOT BE AVOIDED OR ELIMINATED. BY ENTERING THE HOST VENUE (DEFINED BELOW) YOU ARE ACCEPTING THE TERMS AND CONDITIONS OF THIS AGREEMENT AND YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE EVENT. YOU HAVE THE RIGHT TO REFUSE THE TERMS AND CONDITIONS OF THIS AGREEMENT BY NOT PERMITTING YOUR CHILD ENTRY TO THE HOST VENUE.

By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE And A class action waiver. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at https://www.mlb.com/world-baseball-classic will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.

Holder agrees that: a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.

Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which, due to the evolving nature of the COVID-19 pandemic and other matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities. Holder acknowledges that the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).

The WBCI Entities reserve the right to terminate the license granted by this ticket, for any reason, by tendering to Holder the purchase price printed on this ticket. Further, the WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: a) violates the terms of the Agreement, including without limitation any Policy; b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; c) appears to be or is intoxicated; d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; e) uses vulgar or abusive language; or f) poses a risk to the health or safety of others.

Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may be prosecuted.

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation a) terms that mandate or prescribe the quantity of tickets available to be purchased, b) additional requirements regarding Accompanying Parties, and c) terms regarding the resale or transfer of tickets.

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, within ten (10) days preceding the Event, they have:

a) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

b) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

c) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.

ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE

Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) the sole, joint, or comparative negligence, or strict liability, of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.

GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE

ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, A) USE OF THIS TICKET, B) PRESENCE AT THE HOST VENUE OR C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION a) ALL SPECTATOR CLAIMS; b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.

BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.

HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT OR CONCURRENT NEGLIGENCE OF ANY RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.

ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT IS A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)

The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.

Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.

In any Arbitration Claim to be resolved by arbitration, neither Holder nor the WBCI Entities will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and the WBCI Entities would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.

Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.

Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).

YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.

Prior to bringing a claim under this Arbitration Agreement, the Claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must a) identify the Claimant by name, address, email address, and telephone number; b) explain the nature of the Arbitration Claim and the relief demanded; and c) be submitted only on behalf of the Claimant, and not on behalf of any other party. The Claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY ACCOMPANYING MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

NOTICE

This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at https://www.mlb.com/world-baseball-classic. No part of the purchase price will be refunded by reason of the failure of Holder to use this ticket for the Rescheduled Event.

Should the Event (or any portion thereof) a) be canceled and not rescheduled at the Host Venue, b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or c) be played without fans, or with limited fans, in attendance, the WBCI Entities will determine in their sole discretion whether any refunds will be issued and post such decision at https://www.mlb.com/world-baseball-classic.

Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE And A class action waiver. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at https://www.mlb.com/world-baseball-classic will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.

Holder agrees that: (a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); (b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and (c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc., Arizona Diamondbacks Events and Entertainment LP (“ADEE”), AZPB Limited Partnership (dba “Arizona Diamondbacks”), AZPB REM Limited Partnership, AZPB FM Limited Partnership, Maricopa County Stadium District, and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.

Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which, due to the evolving nature of the COVID-19 pandemic and other matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities. Holder acknowledges that the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).

The WBCI Entities reserve the right to terminate the license granted by this ticket, for any reason, by tendering to Holder the purchase price printed on this ticket. Further, the WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: (a) violates the terms of the Agreement, including without limitation any Policy; (b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; (c) appears to be or is intoxicated; (d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; (e) uses vulgar or abusive language; or (f) poses a risk to the health or safety of others.

Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may be prosecuted.

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation (a) terms that mandate or prescribe the quantity of tickets available to be purchased, (b) additional requirements regarding Accompanying Parties, and (c) terms regarding the resale or transfer of tickets.

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, within ten (10) days preceding the Event, they have:

(a) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

(b) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

(c) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.

ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE

Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) the sole, joint, or comparative negligence, or strict liability, of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.

GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE

ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE HOST VENUE OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION (a) ALL SPECTATOR CLAIMS; (b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; (c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR (d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.

BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.

HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF ANY RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.

ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT IS A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)

The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.

Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.

In any Arbitration Claim to be resolved by arbitration, neither Holder nor the WBCI Entities will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and the WBCI Entities would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, *WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. *The arbitrator(s) may not consolidate the claims of multiple parties.

Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.

Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).

YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.

Prior to bringing a claim under this Arbitration Agreement, the claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must (a) identify the claimant by name, address, email address, and telephone number; (b) explain the nature of the Arbitration Claim and the relief demanded; and (c) be submitted only on behalf of the claimant, and not on behalf of any other party. The claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. Should the Event (or any portion thereof) (a) be canceled and not rescheduled at the Host Venue, (b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or (c) be played without fans, or with limited fans, in attendance, the WBCI Entities will determine in their sole discretion whether any refunds will be issued and post such decision at https://www.mlb.com/world-baseball-classic.

Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

TICKET TERMS

Scope of the Agreement

The purchase and use of tickets to events of World Baseball Classic, Inc., 1271 Avenue of the Americas, New York, New York 10020, [email protected] (“WBCI”) as well as access to the venue (“Host Venue”) are subject to the following ticket terms and conditions (the “Agreement”) as well as the applicable house or stadium rules (for the Regensburg Legionaere these are provided at https://legionaere.de/ballpark). By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the Agreement. WBCI may change the terms of the Agreement if the market conditions and/or the legal situation and/or the case law of the high courts change with a period of notice of four (4) weeks in advance, provided that this is reasonable for the Holder (“Agreement Updates”). The respective changes shall be posted at https://www.mlb.com/world-baseball-classic. The supplements or amendments shall be deemed to have been approved if the Holder has not objected to them in writing (Regensburg Legionaere, Donaustaufer Str. 256, 93055 Regensburg, Germany) or by e-mail ([email protected]) and uses the ticket after the Agreement Update. Holder is solely responsible for reading and understanding the Agreement before using this ticket.

Admission to the stadium

Holder (a) consents to security searches, screenings and/or inspection of Holder’s person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”) which can be accessed at https://www.mlb.com/world-baseball-classic, all of which, due to the evolving nature of the COVID-19 pandemic and other matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities. The currently valid local COVID-19 regulations can be accessed at https://www.regensburg.de/aktuelles/coronavirus/corona-regelungen. The WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, if Holder: a) violates the terms of the Agreement, including without limitation any Policy; b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; c) appears to be or is intoxicated; d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; e) uses vulgar or abusive language; or f) poses a risk to the health or safety of others.

Children are only admitted with a valid ticket. Children up to the age of 14 are only admitted accompanied by an adult.

ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT EXPRESSLY FORBIDDEN. VIOLATORS MAY BE EXCLUDED FROM THE EVENT AND PURSUED ACCORDING TO THE APPLICABLE REGULATIONS.

Use, resale, return and refund of tickets

ALL EVENT TIMES MAY BE SUBJECT TO NECESSARY CHANGE. THE WBCI ENTITIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.

§ 355 BGB does not apply to the purchase of tickets, as WBCI’s services are leisure services within the meaning of § 312g II No. 9 BGB. This means, that a two-week right of revocation and return does not apply.

Retain possession of this ticket until the Event has been completed. This ticket cannot be replaced if lost, stolen or destroyed. This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. In exceptional cases, the ticket may be passed on to a third party, in particular in individual cases of illness or unforeseen incapacity of the purchaser, if the Holder expressly informs the new ticket holder about the content of this Agreement and the latter agrees to this Agreement.

Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at https://www.mlb.com/world-baseball-classic. If the Event (or a portion thereof) is postponed or rescheduled, and the Holder cannot or does not wish to attend the Rescheduled Event, the Holder may revoke the ticket purchase. The revocation must be declared in text form (e-mail is sufficient) to [email protected] or in writing by post to Regensburg Legionaere, Donaustaufer Str. 256, 93055 Regensburg, Germany. In case of a revocation, Holder will receive a refund of the ticket price paid to the payment method used for payment of the ticket.

Should the Event (or any portion thereof) a) be canceled and not rescheduled at the Host Venue, b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or c) be played without fans, or with limited fans, in attendance, both the WBCI Entities and the Holder shall be entitled to revoke the ticket purchase. The revocation must be declared in text form (e-mail is sufficient) to [email protected] or in writing by post to Regensburg Legionaere, Donaustaufer Str. 256, 93055 Regensburg, Germany. In case of a revocation, Holder will receive a refund of the ticket price paid to the payment method used for payment of the ticket.

Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued unless the WBCI Entities are responsible for the cancellation of the match or a consideration of the conflicting interests of the Holder with the interests of the WBCI Entities argue in favour of a refund to Holder in the individual case.

Liability

Holder recognizes that attendance at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings. By using this ticket or by attending, observing or participating in the Event, Holder acknowledges the risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder agrees that the participation in, attendance at, and/or observation of the Event is at Holder’s own risk.

The WBCI Entities, their legal representatives and/or vicarious agents can only be held liable in the event of intent or gross negligence. In the event of a breach of material contractual obligations, liability shall be limited to the foreseeable damage typical for the contract. Material contractual obligations are those whose fulfilment is essential to the proper performance of the Agreement, whose breach jeopardises the achievement of the purpose of the Agreement and on whose compliance the Holder regularly relies. This limitation of liability does not apply to claims for compensation for damages due to injury to life, limb or health or due to other legally mandatory liability provisions.

Pictures and Recordings

Holder agrees that: (a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”) unless this is done exclusively for private, non-commercial purposes and (b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information.

Portrait Rights

Holder agrees that for the purpose of public reporting and advertising of the Event and the respective competition WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable. § 23 II KunstUrhG remains unaffected.

Alternative dispute resolution in accordance with the Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz)

WBCI is not prepared and not obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

Final clauses

If individual clauses of this Agreement should be in whole or in part invalid, this shall not affect the validity of the remaining clauses or the remaining parts of such clauses. In the event of an invalid provision, the parties shall negotiate to replace it with a provision that comes as close as possible to the economic purpose of the invalid provision. The same shall also apply to a regulatory gap in this Agreement.

ALLGEMEINE TICKET-GESCHÄFTSBEDINGUNGEN

Geltungsbereich

Der Erwerb und die Nutzung von Eintrittskarten für Veranstaltungen der World Baseball Classic, Inc., 1271 Avenue of the Americas, New York, New York 10020, [email protected] („WBCI“) sowie der Zutritt zum und Aufenthalt im Austragungsort („Austragungsort“) unterliegen den folgenden allgemeinen Ticket-Geschäftsbedingungen (der „Vertrag“) sowie der geltenden Haus- bzw. Stadionordnung (für die Guggenberger Legionäre sind diese unter https://legionaere.de/ballpark zu finden). Mit der Nutzung dieses Tickets unterwirft sich der Karteninhaber im eigenen Namen und ggf. im Namen minderjähriger Begleitpersonen (zusammen „Inhaber“) dem Vertrag. WBCI kann die Bedingungen des Vertrages mit einer Ankündigungsfrist von vier (4) Wochen im Voraus ändern, wenn sich die Marktbedingungen und/oder die Rechtslage und/oder die höchstrichterliche Rechtsprechung ändern, sofern dies für den Inhaber zumutbar ist („Änderungen“). Die Zustimmung zu den Änderungen gilt als erteilt, wenn der Inhaber ihnen nicht schriftlich (Legionäre Baseball AG, Donaustaufer Str. 256, 93055 Regensburg, Deutschland) oder per E-Mail ([email protected]) widerspricht und das Ticket nach der Änderung nutzt. Der Inhaber ist selbst dafür verantwortlich, den Vertrag zu lesen und zu verstehen, bevor er dieses Ticket nutzt.

Zutritt zum Austragungsort

Der Inhaber erklärt sich mit angemessenen Kontrollen seiner Person, seiner Taschen, seiner Kleidung oder anderen Gegenständen zu Sicherheitszwecken (bspw. durch begehbare Metalldetektoren, tragbare Metalldetektoren, Taschenkontrollen) einverstanden. Der Inhaber ist verpflichtet, alle relevanten Regeln und Vorgaben zu befolgen, die von den WBCI-Unternehmen herausgegeben wurden, insbesondere Regeln und Vorgaben in Bezug auf Sicherheit, zulässige Taschen, Fan-Verhalten und/oder Gesundheit und Sicherheit (jeweils eine „Regel“, und zusammen die „Regeln“, abrufbar unter https://www.mlb.com/world-baseball-classic) einzuhalten. Bitte beachten Sie, dass die Regeln bei Bedarf an die aktuellen Entwicklungen der COVID-19-Pandemie und anderer Vorgaben im Zusammenhang mit der Gesundheit, Sicherheit oder Ähnlichem zwischen dem Kauf dieses Tickets und dem Veranstaltungsdatum angepasst werden können. Der Inhaber ist zudem verpflichtet, alle anwendbaren Gesetze, Verordnungen und Richtlinien nationaler und lokaler Behörden einzuhalten. Die WBCI-Unternehmen behalten sich das Recht vor, den Zutritt zur Veranstaltung ohne Rückerstattung des Kaufpreises zu verweigern oder den Inhaber vom Austragungsort zu verweisen, wenn der Inhaber: (a) gegen die Bestimmungen dieses Vertrages verstößt, insbesondere gegen die Regeln (b) im Besitz von Gegenständen oder Objekten ist, die nach Ansicht der WBCI-Unternehmen potenziell gefährlich, gefährlich oder unangemessen sind und/oder eine Verletzungsgefahr für andere Besucher darstellen (zusammenfassend als „Verbotene Gegenstände“ bezeichnet); Verbotene Gegenstände können beschlagnahmt werden; (c) offensichtlich unter Alkohol- oder Drogeneinfluss steht; (d) ein Verhalten an den Tag legt, das von einer der WBCI-Unternehmen als unangemessen oder anstößig angesehen wird; (e) vulgäre oder beleidigende Sprache verwendet; oder (f) eine Gefahr für die Gesundheit oder Sicherheit anderer darstellt.

Kinder haben nur mit einer gültigen Eintrittskarte Zutritt. Kinder im Alter bis zu 14 Jahren haben nur in Begleitung einer erwachsenen Person Zutritt.

DAS BETRETEN DES SPIELFELDES, DIE SONSTIGE STÖRUNG EINER VERANSTALTUNG UND/ODER DER VERSUCH, KÖRPERLICHEN KONTAKT MIT EINEM VERANSTALTUNGSTEILNEHMER AUFZUNEHMEN IST AUSDRÜCKLICH UNTERSAGT. ZUWIDERHANDELNDE KÖNNEN VON DER VERANSTALTUNG AUSGESCHLOSSEN UND GEMÄSS DEN GELTENDEN BESTIMMUNGEN ZIVIL- UND/ODER STRAFRECHTLICH VERFOLGT WERDEN.

Nutzung, Weiterverkauf, Rücktritt und Erstattung von Tickets

ALLE VERANSTALTUNGSZEITEN KÖNNEN NOTWENDIGEN ÄNDERUNGEN UNTERLIEGEN. DIE WBCI-UNTERNEHMEN HAFTEN NICHT FÜR VERLORENE, GESTOHLENE ODER DUPLIZIERTE TICKETS.

§ 355 BGB gilt nicht für den Kauf von Tickets, da es sich bei den Dienstleistungen von WBCI um Freizeitdienstleistungen im Sinne des § 312g II Nr. 9 BGB handelt. Dies bedeutet, dass ein zweiwöchiges Widerrufs- und Rückgaberecht nicht besteht.

Bewahren Sie dieses Ticket auf, bis die Veranstaltung zu Ende ist. Dieses Ticket kann bei Verlust, Diebstahl oder Defekten, die der Inhaber zu vertreten hat, nicht ersetzt werden. Das Ticket gilt nur für diese Veranstaltung, und es wird kein Teil des Kaufpreises zurückerstattet, wenn der Karteninhaber sie nicht für diese Veranstaltung nutzt. In Ausnahmefällen kann das Ticket an einen Dritten weitergegeben werden, insbesondere in Einzelfällen bei Krankheit oder unvorhergesehener Verhinderung des Erwerbers, wenn der Inhaber den neuen Karteninhaber ausdrücklich auf den Inhalt dieses Vertrages hinweist, und dieser dem Vertrag zustimmt.

Sollte diese Veranstaltung abgesagt oder abgebrochen werden, und WBCI nach eigenem Ermessen entscheiden, dass, die Veranstaltung (ganz oder teilweise) am Austragungsort wiederholt oder fortgesetzt wird (die „Verschobene Veranstaltung“), berechtigt dieses Ticket den Ticketinhaber zum Besuch der Verschobenen Veranstaltung an dem Datum und zu der Uhrzeit, zu der die Verschobene Veranstaltung stattfinden soll. Datum und Uhrzeit der Verschobenen Veranstaltung wird von WBCI festgelegt und unter https://www.mlb.com/world-baseball-classic veröffentlicht. Wenn die Veranstaltung (ganz oder teilweise) abgesagt oder abgebrochen wird, und der Inhaber die Verschobene Veranstaltung nicht besuchen kann oder möchte, kann er vom Ticketkauf zurücktreten. Der Rücktritt muss in Textform (E-Mail genügt) an [email protected] oder schriftlich per Post an Legionäre Baseball AG, Donaustaufer Str. 256, 93055 Regensburg, Deutschland erklärt werden. Im Falle eines Rücktrittts erhält der Inhaber den gezahlten Ticketpreis auf das für die Bezahlung des Tickets verwendete Zahlungsmittel zurück.

Sollte die Veranstaltung (ganz oder teilweise) (a) abgesagt und nicht am Austragungsort neu angesetzt werden, (b) noch kein reguläres Spiel nach den Official Baseball Rules 7.01 (ein „Reguläres Spiel“) darstellen, und nicht am Austragungsort fortgesetzt werden, oder (c) ganz oder zum Teil unter Ausschluss von Zuschauern stattfinden müssen, sind sowohl die WBCI-Unternehmen als auch der Inhaber berechtigt, vom Ticketkauf zurückzutreten. Der Rücktritt des Inhabers muss in Textform (E-Mail ist ausreichend) an [email protected] oder schriftlich per Post an Legionäre Baseball AG, Donaustaufer Str. 256, 93055 Regensburg, Deutschland, erklärt werden. Im Falle eines Rücktritts erhält der Inhaber den gezahlten Ticketpreis auf das für die Bezahlung des Tickets verwendete Zahlungsmittel zurück.

Wird ein laufendes Spiel abgebrochen, das bereits ein Reguläres Spiel darstellt, besteht kein Anspruch des Inhabers auf Erstattung des entrichteten Ticketpreises, es sei denn die WBCI-Unternehmen haben den Spielabbruch zu vertreten, oder eine Abwägung der widerstreitenden Interessen des Inhabers mit den Interessen der WBCI-Unternehmen sprechen im Einzelfall für eine Erstattung zu Gunsten des Inhabers.

Haftung

Die Teilnahme an der Veranstaltung und der Aufenthalt am Veranstaltungsort erfolgt auf eigene Gefahr. Die Teilnahme an der Veranstaltung ist freiwillig und dem Inhaber ist bekannt, dass es zu Verletzungen (einschließlich Tod), Krankheiten und/oder Sachschäden kommen kann. Der Inhaber wird sich zur Vermeidung von Gefahren an alle Regeln halten, wachsam sein und auf seine Umgebung achten. Der Inhaber ist sich der Risiken und Gefahren, der Teilnahme bewusst sowie dass solche Risiken oder Gefahren vor, während oder als Folge der Veranstaltung eintreten können und insbesondere der Gefahr, durch geworfene Baseballschläger, Schlägersplitter, geworfene oder geschlagene Bälle, geworfene, fallen gelassene oder abgeschossene Objekte, Personen oder Tiere verletzt zu werden, und anderer Gefahren oder Ablenkungen sowie möglicher Vorfälle oder Unfälle im Zusammenhang mit Menschenmengen oder dem Fehlverhalten anderer Zuschauer (a) als Zuschauer vor, während und nach einem Baseballspiel (einschließlich aller Aufwärmübungen, Trainings, Aktivitäten vor und nach dem Spiel sowie zwischen den Spielen, Werbeaktionen und Wettbewerbe), und (b) als Besucher, Zuschauer oder Teilnehmer der Veranstaltung..

Die WBCI-Unternehmen, ihre gesetzlichen Vertreter und/oder Erfüllungsgehilfen haften nur bei Vorsatz oder grober Fahrlässigkeit. Im Falle der Verletzung wesentlicher Vertragspflichten ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt. Wesentliche Vertragspflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht, deren Verletzung die Erreichung des Vertragszwecks gefährdet und auf deren Einhaltung der Inhaber regelmäßig vertraut. Diese Haftungsbeschränkung gilt nicht für Schadensersatzansprüche aufgrund der Verletzung des Lebens, des Körpers oder der Gesundheit oder auf Grund sonstiger gesetzlich zwingender Haftungstatbestände

Bilder und Aufzeichnungen der Veranstaltung

Der Aufenthalt am Veranstatungsort zum Zwecke der medialen Berichterstattung über die Veranstaltung (Fernsehen, Hörfunk, Internet, Print, Foto) ist nur mit Genehmigung der WBCI-Unternehmen gestattet. Ohne vorherige Genehmigung dürfen Fotos, Bilder, Videos, Audios, Livestreams oder andere Darstellungen oder Beschreibungen (einschließlich Play-by-Play-Daten) unabhängig davon, ob es sich um Text-, Daten- oder Bildmaterial handelt des Spiels, zu dem dieses Ticket Zutritt gewährt, oder von Teilen hiervon, sowie von Unterhaltungsangeboten, Attraktionen, Aufwärmübungen, Trainings, Aktivitäten vor, nach oder zwischen dem Spiel, von Werbeaktionen oder Wettbewerben, im Zusammenhang mit dem Spiel (das „Spiel“) oder einer anderen Veranstaltung (zusammen mit dem Spiel, „Veranstaltung“), beispielsweise Berichte, Beschreibungen, Bilder, Videos, Audiodateien, Reproduktionen oder andere Informationen über das Spiel oder eine Veranstaltung (zusammen die „Spielinformationen“), nicht übertragen werden, es sei denn, dies geschieht ausschließlich für private, nicht-kommerzielle Zwecke. Es ist untersagt anderer Personen bei derartigen Aktivitäten zu unterstützen. WBCI stehen die alleinigen Rechte am Spiel und an den Spielinformationen zu.

Zuschaueraufnahmen

Zum Zwecke der öffentlichen Berichterstattung und Bewerbung der Veranstaltung und des jeweiligen Wettbewerbs können WBCI, das Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, die Clubs der Major League Baseball, Major League Baseball Properties, Inc, die nationalen Baseballverbände, die an den World Baseball Classic teilnehmen, die Spieler und andere Personen, die an den World Baseball Classic teilnehmen, die Major League Baseball Players Association, MLB Players, Inc. und alle ihre jeweiligen früheren, gegenwärtigen und künftigen Tochtergesellschaften, verbundenen Unternehmen, Vertreter, leitenden Angestellten, Mitarbeiter, Mitglieder, Direktoren und Eigentümer (zusammen die „WBCI-Unternehmen“) sowie bestimmte gegenwärtige und künftige Sponsoren und Lizenznehmer dieser WBCI-Unternehmen Bild- und Bildtonaufnahmen erstellen, die den Inhaber als Zuschauer der betreffenden Veranstaltung zeigen können.

Der Inhaber willigt unwiderruflich für alle gegenwärtigen und zukünftigen Medien in die unentgeltliche Verwendung seines Bildes, seiner Stimme, seiner Kommentare und seines Namens für Fotografien, Live-Übertragungen, Sendungen und/oder Aufzeichnungen von Bild und/oder Ton, die von WBCI-Unternehmen erstellt werden, ein. Die den WBCI-Unternehmen hiermit eingeräumten Rechte sind übertragbar. § 23 II KunstUrhG bleibt unberührt.

Alternative Streitbeilegung nach dem Verbraucherstreitbeilegungsgesetz (VSBG)

WBCI ist nicht bereit und nicht verpflichtet, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen (§ 36 VSBG).

Schlussklauseln

Sollten einzelne Klauseln dieses Vertrages ganz oder teilweise unwirksam sein, so berührt dies die Wirksamkeit der übrigen Klauseln bzw. der übrigen Teile solcher Klauseln nicht. Im Falle einer unwirksamen Bestimmung werden die Parteien darüber verhandeln, diese durch eine Regelung zu ersetzen, die dem wirtschaftlichen Zweck der unwirksamen Bestimmung am nächsten kommt. Das gleiche gilt für eine Regelungslücke in diesem Vertrag.

TICKET TERMS & CONDITIONS

IMPORTANT: THIS TICKET IS A REVOCABLE LICENSE;

HOLDER VOLUNTARILY ASSUMES RISK OF ILLNESS/INJURY; NO RE-ENTRY UPON EXIT; THIS TICKET LIMITS HOLDER’S LEGAL RIGHTS

By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE And A class action waiver. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at https://www.mlb.com/world-baseball-classic will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.

Holder agrees that: a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for purposes of promotion and development of activities related to the Event, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.

Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which, due to the evolving nature of the COVID-19 pandemic and other matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities. Holder acknowledges that the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).

The WBCI Entities reserve the right to terminate the license granted by this ticket, for any reason, by tendering to Holder the purchase price printed on this ticket. Further, the WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: a) violates the terms of the Agreement, including without limitation any Policy; b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; c) appears to be or is intoxicated; d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; e) uses vulgar or abusive language; or f) poses a risk to the health or safety of others.

Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may be prosecuted.

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation a) terms that mandate or prescribe the quantity of tickets available to be purchased, b) additional requirements regarding Accompanying Parties, and c) terms regarding the resale or transfer of tickets.

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, within ten (10) days preceding the Event, they have:

a) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

b) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

c) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.

ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE

Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) a fortuitous event, force majeure and/or strict liability of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.

GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE

ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, A) USE OF THIS TICKET, B) PRESENCE AT THE HOST VENUE OR C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, A FORTUITOUS EVENT, FORCE MAJEURE OR STRICT LIABILITY OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION a) ALL SPECTATOR CLAIMS; b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.

BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.

HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING A FORTUITOUS EVENT, FORCE MAJEURE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.

ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT MAY CONSTITUTE A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)

The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.

Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.

In any Arbitration Claim to be resolved by arbitration, neither Holder nor the WBCI Entities will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and the WBCI Entities would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.

Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.

Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).

YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.

Prior to bringing a claim under this Arbitration Agreement, the Claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must a) identify the Claimant by name, address, email address, and telephone number; b) explain the nature of the Arbitration Claim and the relief demanded; and c) be submitted only on behalf of the Claimant, and not on behalf of any other party. The Claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY ACCOMPANYING MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

NOTICE

ALL EVENT TIMES ARE SUBJECT TO CHANGE. THE WBCI ENTITIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.

Retain possession of this ticket until the Event has been completed. This ticket cannot be replaced if lost, stolen or destroyed. This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at https://www.mlb.com/world-baseball-classic. No part of the purchase price will be refunded by reason of the failure of Holder to use this ticket for the Rescheduled Event.

Should the Event (or any portion thereof) (a) be canceled and not rescheduled at the Host Venue, (b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or c) be played without fans, or with limited fans, in attendance such that Holder is denied entry, a refund will automatically be posted to the payment method used for payment of the ticket.

Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

Al utilizar este boleto, el titular actúa en su nombre y en nombre de cualquier menor que lo acompañe (denominados colectivamente "Titular”), acepta los siguientes términos y condiciones (el “Acuerdo”), incluido un ACUERDO DE ARBITRAJE y una renuncia a la demanda colectiva. El Titular está de acuerdo con: a) No transmitir/ayudar a transmitir fotos, vídeos, audios, transmisiones en directo u otros reportes/descripciones (incluyendo datos del juego en directo, ya sea por medio de texto, información o archivos visuales) por ningún medio de comunicación, de todo o parte del juego al que este boleto otorga entrada, o de cualquier entretenimiento, atracción, calentamiento, prácticas, actividades previas al juego, posteriores al juego o entretiempos, promociones o competencias ofrecidas en relación con el juego (el “Juego”) o cualquier otro suceso (denominados con el Juego colectivamente “Evento”) que incluye, entre otros, cualquier reporte, descripción, imagen, video, audio, reproducción u otra información relacionada con el Juego o Evento (denominados colectivamente “Información del juego”); b) WBCI es el propietario exclusivo de todos los derechos de autor y otros derechos de propiedad sobre el Juego y la Información del juego; y c) WBCI, la oficina del comisionado de béisbol, MLB Advanced Media, L.P., The MLB Network, LLC, los clubes de béisbol de las grandes ligas, Major League Baseball Properties, Inc., las federaciones nacionales de béisbol que participan en el Clásico Mundial de Béisbol, los jugadores y otras personas que participan en el Clásico Mundial de Béisbol, Major League Baseball Players Association, MLB Players, Inc., cada uno de los clubes de béisbol de las ligas mayores, cada una de sus respectivas subsidiarias, afiliadas, agentes, funcionarios, empleados y propietarios pasados, presentes y futuros (denominados colectivamente “Entidades de WBCI”) y ciertos patrocinadores y licenciatarios actuales y futuros de dichas Entidades de WBCI, tendrán el derecho y la licencia sin restricciones para usar la imagen, semejanza, nombre, voz, comentarios u otros derechos de propiedad exclusiva o pública del Titular en cualquier emisión en vivo o registrada, transmisión por televisión, fotografía, vídeo, audio, audiovisual u otra grabación tomada en relación con el Evento u otra transmisión, distribución, desempeño público o reproducción total o parcial del evento, para fines de promoción y desarrollo de actividades relacionadas con el mismo, a nivel mundial, en perpetuidad, y en todos y cada uno de los medios conocidos ahora o en el futuro, sin compensación. Los derechos otorgados en este documento a las Entidades de WBCI son asignables.

El Titular, en su propio nombre y en nombre de las Partes acompañantes (tal como se definen al final de este párrafo), (a) autoriza los registros, controles o inspecciones de seguridad de la persona, bolsos, ropa u otros artículos del Titular o de las Partes acompañantes con fines de seguridad, ya sea mediante un detector de metales fijo o portátil, controles de bolsos o de otro modo; Y (b) reconoce y acepta cumplir con (i) todas las políticas y protocolos pertinentes emitidos por cualquier Entidad WBCI, incluidas, entre otras, las políticas y protocolos relativos a la seguridad, los bolsos, la conducta de los fanáticos o la salud y la protección (cada una denominada “Política” y colectivamente “Políticas”). Todas las políticas, debido a la evolución de la pandemia de COVID-19 y otros asuntos relacionados con la salud, seguridad, protección y similares, podrán actualizarse periódicamente entre la compra de este boleto y la fecha del Evento, al igual que ii) todas las leyes, órdenes y políticas que correspondan de las autoridades nacionales y locales. El Titular reconoce que las Entidades WBCI no tienen responsabilidad alguna por la persona o la propiedad del Titular o de las Partes acompañantes. Una “Parte acompañante” es cualquier persona acompañante (excepto los menores acompañantes) para quien el Titular tenga un boleto para asistir al Evento con él (el titular está autorizado por esa parte y actúa como representante en su nombre al aceptar los términos del Acuerdo que corresponden) (denominados colectivamente “Partes acompañantes”).

Las Entidades WBCI se reservan el derecho de rescindir la licencia otorgada por este boleto, por cualquier motivo, ofreciendo al Titular el precio de compra impreso en este boleto. Además, las Entidades WBCI se reservan el derecho, sin reembolso de ningún porcentaje del precio de compra, de revocar todas las licencias concedidas por este boleto y rechazar la admisión/expulsión al Evento del Titular y de las Partes acompañantes en caso de que dicha persona: a) infrinja las condiciones del Acuerdo, incluida, entre otras, cualquier Política; b) tenga algún artículo u objeto que las Entidades WBCI consideren potencialmente peligroso, riesgoso, inapropiado o perjudicial para otros clientes (denominados colectivamente “Artículos prohibidos”). Dichos Artículos prohibidos podrán ser confiscados; c) parezca estar/está intoxicado; d) incurra en una conducta que cualquiera de las Entidades WBCI considere inapropiada, desordenada o impropia; e) utiliza lenguaje vulgar o abusivo; o f) supone un riesgo para la salud o la seguridad de otros.

El Titular asume todos los riesgos asociados con la compra de este boleto a cualquier persona que no sea WBCI o sus agentes designados. Este boleto no se puede usar para publicidad, promoción (incluidos concursos y sorteos), u otros fines comerciales sin el consentimiento expreso por escrito de WBCI. No se permite ninguna oferta para revender este boleto en la medida en que lo prohíba cualquier ley o regulación correspondiente o en violación de cualquier política. Toda reventa invalidará la licencia otorgada por este boleto. Este boleto no podrá revenderse ni ofrecerse para su reventa dentro de la sede del evento, incluidos el estadio de béisbol, los terrenos circundantes y las zonas de estacionamiento (denominados colectivamente “Sede del evento”). PROMESA DE SALUD PARA LOS FANÁTICOS

El Titular reconoce y comprende que, si está infectado con COVID-19 u otra enfermedad transmisible (tal como se definen al final de este párrafo), el Titular o las Partes acompañantes pueden infectar a otros con los que entren en contacto posteriormente, incluso si no están experimentando o mostrando ningún síntoma de enfermedad, y que el riesgo de exposición para los otros permanece en todo momento. Por consiguiente, el Titular acepta que ni el Titular ni ninguna Parte acompañante asistirán al Evento si, en el plazo de diez (10) días anteriores al mismo, tuvieron:

a) pruebas positivas o presuntamente positivas de COVID-19 u otras enfermedades transmisibles. Han sido identificados como portadoras potenciales de COVID-19 u otra enfermedad transmisible; O

b) han experimentado cualquier síntoma comúnmente asociado con el COVID-19 u otra enfermedad transmisible; O

c) han estado en contacto directo o cercano a cualquier persona que se haya confirmado o se sospeche que esté infectada con COVID-19 u otra enfermedad transmisible.

Una “enfermedad transmisible” tal y como se utiliza en este documento es el COVID-19, todas sus cepas, variantes o mutaciones, el coronavirus que causa COVID-19, cualquier otra enfermedad transmisible por aire, partículas, o superficies; o enfermedades infecciosas, virus, bacterias o las causas de las mismas.

ASUNCIÓN DE RIESGO RELACIONADO CON EL COVID-19 Y OTRAS ENFERMEDADES TRANSMISIBLES

El Titular, en su nombre y en nombre de las Partes acompañantes, reconoce y asume de manera expresa y voluntaria todos los riesgos relacionados con la exposición o infección de COVID-19 o de otra enfermedad transmisible en la Sede del evento. Al utilizar este boleto, el titular está reconociendo y confirmando en su nombre y en el de las Partes relacionadas (tal como se definen en la conclusión de este párrafo), ahora como en el futuro, que entiende y asume expresamente el riesgo de que el Titular o las Partes acompañantes puedan estar expuestos al COVID-19 u otra enfermedad transmisible. El Titular entiende expresamente que estos riesgos incluyen contraer COVID-19 u otra enfermedad transmisible y los peligros asociados, complicaciones médicas y lesiones físicas y mentales, previstas e imprevistas, que pueden derivarse de contraer COVID-19 u otra enfermedad transmisible. El Titular reconoce y entiende, en su nombre y en el de las Partes acompañantes: que cualquier interacción con el público en general supone un riesgo inherente de exposición a una enfermedad transmisible y de contraer dicha enfermedad, incluido, entre otros, el COVID-19; que no se puede garantizar que el Titular o las Partes acompañantes no estén expuestos; y que, como tal, la posible exposición o infección de COVID-19 u otra enfermedad transmisible son riesgos inherentes a la decisión del Titular de utilizar este boleto y no pueden eliminarse. “Partes relacionadas” son todas las Partes acompañantes, así como los representantes personales, cesionarios, herederos, parientes próximos y cualquier otra persona o entidad que pueda tener derecho a presentar una reclamación en su nombre.

ASUNCIÓN DEL RIESGO DE LESIONES PERSONALES, ENFERMEDADES O DAÑOS A LA PROPIEDAD

El Titular reconoce que su presencia y la de las Partes acompañantes en el Evento es voluntaria y puede dar lugar a lesiones personales (incluida la muerte), enfermedad o daños a la propiedad. El Titular acepta cumplir todas las políticas y mantenerse alerta y al tanto de su entorno y aquel de las Partes acompañantes. Al utilizar este boleto o al asistir, observar o participar en el Evento, el Titular, en su nombre y en el de cualquier Parte relacionada, reconoce y asume todos los riesgos y peligros asociados con: (a) ser un espectador antes, durante y después de un partido de béisbol (incluidos todos los calentamientos, las prácticas, las actividades previas al partido, posteriores al partido y entretiempos, las promociones y los concursos), y (b) asistir, observar o participar en el Evento. En cada caso, la existencia de tal riesgo o peligro antes, durante o después del mismo, incluyendo específicamente (pero no exclusivamente) el peligro de resultar lesionado por bates lanzados; fragmentos de bates; bolas lanzadas o bateadas; artículos lanzados, caídos o arrojados; proyectiles; personas; animales; otros riesgos o distracciones; y los incidentes o accidentes asociados con multitudes de personas o la negligencia o conducta indebida de otros espectadores. El Titular, en su nombre y en el de cualquier Parte relacionada, acepta que las Partes exoneradas (tal como se definen al final de este párrafo) no serán responsables de ninguna lesión personal (incluida la muerte), enfermedad, daño a la propiedad u otra pérdida sufrida como resultado de (x) la participación u observación del Titular o de las Partes acompañantes del Evento, o (y) de un evento fortuito, fuerza mayor o responsabilidad estricta de cualquiera de las Partes exoneradas (denominadas colectivamente, el “Reclamaciones de espectadores”). Las “Partes exoneradas” son: (i) las Entidades WBCI, (ii) cada uno de los respectivos licenciatarios, patrocinadores y proveedores pasados, presentes y futuros de las Entidades WBCI, y todos sus sucesores y cesionarios, (iii) todas las demás entidades relacionadas con el Clásico Mundial de Béisbol, (iv) la Sede del evento y los propietarios u operadores de la misma, (v) cualquier organismo gubernamental asociado con la Sede del evento, (vi) el vendedor o proveedor de boletos, y (vii) todos los afiliados, sucesores, cesionarios, jugadores, gerentes, entrenadores, empleados, socios, miembros, directores, ejecutivos, propietarios, agentes, representantes y contratistas independientes de dichas entidades.

LIBERACIÓN GENERAL DE RESPONSABILIDAD Y CONVENIO DE NO DEMANDAR

EN SU PROPIO NOMBRE Y EN EL DE LAS PARTES RELACIONADAS, EL TITULAR, RENUNCIA, LIBERA, EXONERA DE RESPONSABILIDAD Y ACEPTA EL CONVENIO DE NO DEMANDAR A LAS PARTES EXONERADAS CON RESPECTO A CUALQUIER RECLAMACIÓN, RESPONSABILIDAD O DEMANDA DE CUALQUIER TIPO O NATURALEZA, CONFORME A DERECHO O EQUIDAD, QUE PUEDAN SURGIR EN RELACIÓN O RELACIONARSE DE ALGUNA MANERA CON, A) USO DE ESTE BOLETO, B) PRESENCIA EN LA SEDE DEL EVENTO O C) PARTICIPACIÓN EN EL EVENTO O DE CUALQUIER ACTIVIDAD RELACIONADA ORGANIZADA, PROMOVIDA O PATROCINADA POR LAS PARTES EXONERADAS, INCLUIDOS, ENTRE OTROS, LAS RECLAMACIONES QUE SURJAN COMO RESULTADO DE: (I) EN SU TOTALIDAD O EN PARTE, UN EVENTO FORTUITO, FUERZA MAYOR O RESPONSABILIDAD ESTRICTA DE LAS PARTES EXONERADAS, O (II) LOS RIESGOS INHERENTES ASOCIADOS A SU VISITA A LA SEDE DEL EVENTO, INCLUYENDO, ENTRE OTROS a) TODAS LAS RECLAMACIONES DE ESPECTADORES; b) TODAS LAS RECLAMACIONES POR LESIONES PERSONALES, MUERTE DOLOSA, EXPOSICIÓN O INFECCIÓN DE COVID-19 U OTRA ENFERMEDAD TRANSMISIBLE POR EL TITULAR, LAS PARTES ACOMPAÑANTES U OTRAS PERSONAS EXPUESTAS AL COVID-19 U OTRA ENFERMEDAD TRANSMISIBLE POR EL TITULAR O LAS PARTES ACOMPAÑANTES; c) TODAS LAS RECLAMACIONES RELACIONADAS CON REGISTROS O CONTROLES DE SEGURIDAD, O CON LA APLICACIÓN DE PROTOCOLOS DE SALUD Y PROTECCIÓN AL TITULAR O A LAS PARTES ACOMPAÑANTES; O d) TODAS LAS RECLAMACIONES POR INVASIÓN DE LA PRIVACIDAD, DIFAMACIÓN, VIOLACIÓN DE CUALQUIER DERECHO DE PUBLICIDAD, DERECHO DE PRIVACIDAD O CUALQUIER OTRA CAUSA DE ACCIÓN QUE SURJA DE LA PRODUCCIÓN, REPRODUCCIÓN, DISTRIBUCIÓN, TRANSMISIÓN, PUBLICACIÓN, DIFUSIÓN PÚBLICA, DIFUSIÓN O EXHIBICIÓN DE ANUNCIOS, PROMOCIONES, CONTENIDOS, PROGRAMAS O MATERIALES EN LOS QUE APAREZCAN GRABACIONES O FOTOGRAFÍAS DEL TITULAR O DE CUALQUIERA DE LAS PARTES ACOMPAÑANTES DEL EVENTO (DENOMINADOS COLECTIVAMENTE “RECLAMACIONES LIBERADAS”).

Los reconocimientos y asunciones expresas de riesgo, renuncias a reclamaciones y liberaciones de responsabilidad contenidas en este documento tienen por objeto ser exenciones obligatorias y completas de reclamaciones y exoneraciones de responsabilidad, y se interpretan como tan amplias e inclusivas como lo permite la ley, incluso con respecto a cualquier controversia, reclamación o disputa que pueda surgir relacionada con la exposición o infección de COVID-19 u otra enfermedad transmisible. Si se considera que alguna parte de este documento es inválida o jurídicamente inaplicable por cualquier motivo (“Disposición afectada”), el resto del Acuerdo no se verá afectado por ello y seguirá siendo válido y plenamente aplicable. La Disposición afectada se ejecutará en la medida máxima permitida por la ley.

AL ASISTIR O PARTICIPAR EN EL EVENTO SE CONSIDERARÁ QUE EL TITULAR, EN SU NOMBRE Y EN NOMBRE DE CUALQUIER PARTE ACOMPAÑANTE, HA OTORGADO A LAS PARTES EXONERADAS, EN LA MÁXIMA MEDIDA DE LO PERMITIDO POR LA LEY, UNA EXENCIÓN TOTAL DE LA RESPONSABILIDAD.

SI LOS MENORES O PARTES ACOMPAÑANTES ASISTEN AL EVENTO CON EL TITULAR, SE CONSIDERARÁ QUE EL TITULAR HA OTORGADO LA TOTALIDAD DE LOS DERECHOS, LAS CESIONES Y LAS EXENCIONES PRECEDENTES EN NOMBRE DE: (A) DICHOS MENORES COMO SU PADRE O TUTOR O COMO EL AGENTE AUTORIZADO DE SU PADRE O TUTOR; O (B) DE OTRAS PARTES ACOMPAÑANTES COMO SU AGENTE AUTORIZADO. EN CASO DE QUE EL TITULAR NO DESEE O NO ESTÉ AUTORIZADO A OTORGAR TALES DERECHOS, LAS CESIONES Y LAS EXENCIONES EN NOMBRE DE: (I) DICHOS MENORES, EL TITULAR DEBERÁ ABANDONAR INMEDIATAMENTE LA SEDE DEL EVENTO CON LO MENORES; O (II) CON CUALQUIER OTRO ACOMPAÑANTE.

El Titular indemnizará, defenderá y eximirá de responsabilidad a las Partes exoneradas de y contra cualquier demanda, reclamación, costo (incluidos los honorarios y gastos razonables de abogados), gastos y responsabilidad que surja de, sea incidental o esté relacionado de alguna manera con (i) las Reclamaciones liberadas, (ii) los actos u omisiones del Titular o de las Partes acompañantes, o (iii) el incumplimiento por parte del Titular de cualquiera de los términos, condiciones o representaciones aceptadas en el Acuerdo.

EL TITULAR ACEPTA QUE LAS OBLIGACIONES DE INDEMNIZACIÓN Y LAS RESPONSABILIDADES ASUMIDAS EN ESTE DOCUMENTO SON SIN LÍMITE Y SIN CONSIDERAR LA CAUSA O CAUSAS DE LAS MISMAS, INCLUIDO UN EVENTO FORTUITO, FUERZA MAYOR, RESPONSABILIDAD ESTRICTA, DEFECTOS O CONDICIONES LATENTES, PATENTES O PREEXISTENTES, E INCLUYENDO CUALQUIER RECLAMACIÓN DERIVADA DEL INGRESO, SALIDA, CARGA Y DESCARGA DE PERSONAL O CARGAMENTO.

INGRESAR AL CAMPO DE JUEGO, INTERRUMPIR EL EVENTO DE CUALQUIER MANERA O INTENTAR CUALQUIER CONTACTO FÍSICO CON UN PARTICIPANTE DEL EVENTO PUEDE CONSTITUIR UN DELITO PUNIBLE CON MULTA O ENCARCELAMIENTO. LOS INFRACTORES PUEDEN SER PROCESADOS EN LA MEDIDA EN QUE LO PERMITA LA LEY.

ACUERDO DE ARBITRAJE OBLIGATORIO Y RENUNCIA A LA DEMANDA COLECTIVA (“ACUERDO DE ARBITRAJE”)

Las Entidades WBCI se preocupan profundamente por mantener buenas relaciones con los fanáticos. En caso de que usted o cualquier Parte acompañante tenga un problema con el boleto o el Evento, puede resolver el asunto de forma rápida y amistosa llamando al servicio al cliente. Cualquier disputa que no se resuelva de manera informal debe resolverse de conformidad con este Acuerdo de arbitraje.

USTED TIENE DERECHO A RECHAZAR ESTE ACUERDO DE ARBITRAJE, PERO DEBE EJERCER ESTE DERECHO DE INMEDIATO. IMPORTANT: THIS TICKET IS A REVOCABLE LICENSE;

HOLDER VOLUNTARILY ASSUMES RISK OF ILLNESS/INJURY; NO RE-ENTRY UPON EXIT; THIS TICKET LIMITS HOLDER’S LEGAL RIGHTS

By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE And A class action waiver. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at https://www.mlb.com/world-baseball-classic will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.

Holder agrees that: a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.

Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which, due to the evolving nature of the COVID-19 pandemic and other matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities. Holder acknowledges that the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).

The WBCI Entities reserve the right to terminate the license granted by this ticket, for any reason, by tendering to Holder the purchase price printed on this ticket. Further, the WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: a) violates the terms of the Agreement, including without limitation any Policy; b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; c) appears to be or is intoxicated; d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; e) uses vulgar or abusive language; or (f) poses a risk to the health or safety of others.

Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may be prosecuted.

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation (a) terms that mandate or prescribe the quantity of tickets available to be purchased, (b) additional requirements regarding Accompanying Parties, and © terms regarding the resale or transfer of tickets.

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, within ten (10) days preceding the Event, they have:

a)tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

b)experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

c)been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.

ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE

Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) the sole, joint, or comparative negligence, or strict liability, of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.

GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE

ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, A) USE OF THIS TICKET, B) PRESENCE AT THE HOST VENUE OR C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION a) ALL SPECTATOR CLAIMS; b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.

BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.

HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF ANY RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.

ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT IS A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

TO THE EXTENT PERMITTED BY LAW, IF A HOLDER INCURS DAMAGE DUE TO WBCI’S BREACH OF ANY OF THE AGREEMENT, THE MAXIMUM AMOUNT OF DAMAGES PAYABLE TO HOLDER WILL BE THE TOTAL AMOUNT OF THE FACE VALUE OF THE TICKETS APPLIED FOR, PURCHASED OR HELD. IN ADDITION, WBCI ENTITIES WILL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT OR INCIDENTAL DAMAGES DUE TO THEIR HAVING BREACHED THE AGREEMENT. THE ABOVE RELEASE OF LIABILITY OR ANY LIMITATION OF LIABILITY GIVEN FOR WBCI ENTITIES UNDER THIS AGREEMENT DOES NOT APPLY IN CASE THE RELEASED CLAIMS ARE CAUSED BY GROSS NEGLIGENCE OR WILLFUL MISCONDUCTS OF ANY OF WBCI ENTITIES.

MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)

The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.

Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.

In any Arbitration Claim to be resolved by arbitration, neither Holder nor the WBCI Entities will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and the WBCI Entities would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.

Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.

Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).

YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.

Prior to bringing a claim under this Arbitration Agreement, the Claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must a) identify the Claimant by name, address, email address, and telephone number; b) explain the nature of the Arbitration Claim and the relief demanded; and c) be submitted only on behalf of the Claimant, and not on behalf of any other party. The Claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY ACCOMPANYING MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

NOTICE

ALL EVENT TIMES ARE SUBJECT TO CHANGE. THE WBCI ENTITIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.

Retain possession of this ticket until the Event has been completed. This ticket cannot be replaced if lost, stolen or destroyed. This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at https://www.mlb.com/world-baseball-classic. No part of the purchase price will be refunded by reason of the failure of Holder to use this ticket for the Rescheduled Event.

Should the Event (or any portion thereof) a) be canceled and not rescheduled at the Host Venue, b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or c) be played without fans, or with limited fans, in attendance, the WBCI Entities will determine in their sole discretion whether any refunds will be issued and post such decision at https://www.mlb.com/world-baseball-classic.

Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

本チケットを使用することにより、チケットの保有者は、自らのため、かつ同伴する未成年者(以下併せて「保有者」といいます。)に代わり、仲裁および集団訴訟の放棄に関する合意(AGREEMENT TO ARBITRATE A class action waiver)を含む、以下の条件(以下「本規約」といいます。)に同意したものとします。 World Baseball Classic, Inc.(以下「WBCI」といいます。)は、本規約の内容を、予告なく、時期を問わず、変更することができるものとします(以下「規約更新」といいます。)。保有者は、規約更新がウェブサイト( https://www.mlb.com/world-baseball-classic )上に掲載され、その後に本チケットを使用した場合、その規約更新を承認したものとみなされます。保有者は、本チケットを使用する前に、自らの責任において、本規約に記載された事項を確認し、その内容を理解するものとします。なお、本規約において一定の行為をすることまたはしないこと、一定の権利を付与することを保有者が同意することについて定めた規定は、保有者と同伴の未成年者の双方を、現在および将来に亘って拘束するものとし、該当する場合には、チケット保有者は、同伴の未成年者をして、本規約で保有者が、自らと同伴する未成年者のために同意した本規約に定めるところにより、一定の行為をさせもしくはさせず、また一定の権利を付与させるものとします。

新型コロナウイルス感染症(COVID-19)は、感染力が極めて強い感染症であり、感染した場合は重篤な症状が生じる可能性や死に至る可能性もあります。公共の場での活動においては、細心の注意を払い感染症対策を講じたとしても、新型コロナウイルス感染症(COVID-19)へ感染するリスクが不可避的に生じます。保有者は、自己および同行者(後に定義します。)のために、(a)新型コロナウイルス感染症(COVID-19)およびその他の感染症に関連するあらゆるリスクを負い、(b)関連するWBCIの健康および安全ポリシーをすべて遵守することに同意するものとします

保有者は、以下の事項に同意するものとします: a) 保有者は、本チケットにより入場が認められる試合の全部もしくは一部、または当該試合に関連して提供されるあらゆる興行、アトラクション、準備運動、練習、試合前・試合後・イニング間の活動、宣伝、競技(以下「本試合」といいます。)その他のイベント(以下本試合と合せて「本イベント」といいます。)の、あらゆる写真、画像、動画、音声、ライブストリーム、その他の説明、解説(実況情報を含みます。)(文字、データ、映像のいずれであるかを問いません。)(本試合または本イベントに関連するあらゆる説明、解説、写真、動画、音声、再現、その他の情報(以下「本試合情報」といいます。)を含みます。)を、いかなる媒体を用いても、送信または送信の補助をしてはなりません。 b)WBCIは、本試合および本試合情報に含まれるすべての著作権その他の財産権を、独占的に保有します。c) WBCI、Office of the Commissioner of Baseball、MLB Advanced Media,L.P.、The MLB Network, LLC 、Clubs of Major League Baseball、Major League Baseball Properties, Inc.、World Baseball Classicに参加する各国の野球連盟、World Baseball Classicに参加する選手およびその他の個人、Major League Baseball Players Association、MLB Players, Inc.およびこれらの団体または個人、それぞれの過去、現在、将来の子会社、関連会社、エージェント、役員、従業員、社員、役員およびオーナー(以下総称して「WBCI関係者」といいます。)、ならびにWBCI関係者の現在および将来のスポンサーおよびライセンシーは、本イベントに関連して撮影・記録された生放送、録画放送、テレビ放送、写真、動画、音声、オーディオビジュアルもしくはその他の記録、または本イベントの全体または一部の送信、頒布、公演、複製に含まれる保有者の画像、肖像、氏名、音声、コメント、その他有形無形を問わずあらゆる種類の財産権および公権を、全世界で、現在または将来のあらゆるメディアにおいて、 あらゆる目的のために、永久に、無制限に、無償で利用できる権利を有します。WBCI関係者は、本規約で付与された権利を譲渡することができます。

保有者は、自らのため、および同行者(本段落末尾に定義します。)に代わり、(a)ゲート型金属探知機、ハンドヘルド金属探知機、手荷物検査、その他の手段による、保有者および同行者の身体、バッグ、衣類、その他物品 を対象とする、セキュリティのための検査、選別および/または調査を受けることに同意し、(b) (i) WBCI関係者が定める、関連する一切の規則および手順(以下「規則等」といいます。規則等には、セキュリティ、バッグ、ファン行動または健康、安全に関する規則および手順を含みます。なお、これらの規則および手順は、新型コロナウイルス感染症(COVID-19)の感染拡大、健康、セキュリティ、安全等に関連する事情に伴い、本チケットの購入の時から本イベント当日までの間、随時更新されることがあります。)、ならびに(ii) 適用されるすべての国および地方自治体による法、規則および方針を遵守することに同意します。保有者は、WBCI関係者が、保有者および同行者個人およびその財産に対して、いかなる責任も負わないことに同意するものとします。「同行者」とは、保有者と共にイベントに参加するために、保有者がそのチケットを保有する同行者(同伴の未成年者を除きます。)であって、保有者は、同行者は保有者に対して同行者を代理して本規約の関連条項に同意する権限を付与したことを表明するものとします。

WBCI関係者は、理由の如何を問わず、本チケットに記載された購入代金を保有者に提供することにより、本チケットにより付与された権利を無効にすることができます。また、WBCI関係者は、保有者が次のいずれかに該当する場合、購入金額の全部または一部の払戻しなく、本チケットにより付与された権利の一部または全部を無効にし、保有者および同伴者の本イベントへの入場を拒否し、または本イベントから保有者および同伴者を退場させることができます:a) 本規約(規則等を含みます。)に違反した場合、b) WBCI関係者が危険、有害、不適切または他の来場者を傷つける可能性があると判断する物品(以下「禁止物品」といいます。)を所持する場合(この場合、当該禁止物品を没収することがあります。)、c) 酩酊しまたは外見上酩酊している様子である場合、 d) WBCI関係者が不適切、不適当または無秩序と判断する行為を行った場合、e) 粗野なまたは乱暴な言葉を用いた場合、f) 他人の健康または安全を脅かす場合

本チケットをWBCIまたはその指定代理店以外の者から購入することに伴うリスクは、すべて保有者が負うものとします。本チケットは、WBCIの書面による明示的な同意なく、広告、宣伝(コンテストや懸賞を含みます。)、その他の取引または商業目的に使用することは認められません。本チケットの転売または転売の申出は、適用法令によって禁止され、または規則等の違反となる限りにおいて、認められません。このような転売を行った場合、本チケットによって付与された権利は無効となります。本チケットは、球場およびその周辺や駐車場などの競技会場内(以下総称して「競技会場」といいます。)において、転売または転売の申出をすることはできず、競技会場内において、いかなる価格であれ本チケットを転売目的で販売または販売の申出を行った場合には、敷地内から退出しなければならず、また、訴追される場合もあります。

保有者は、自らのため、および同行者に代わり、本契約に明記されておらず、本チケットの購入時に提示される条件(a)購入可能なチケット枚数を規定する条件、b)同行者に関する追加条件、c)チケットの転売または譲渡に関する条件を含みます。)をすべて遵守することに同意するものとします。

ファンの健康に関する約束事項

保有者は、保有者および/または同行者が新型コロナウイルス感染症(COVID-19)またはその他の感染症(本段落末尾に定義します。)に罹患した場合、たとえ症状がなくても、その後接触した他人に感染させる可能性や、常に他人に暴露させる危険性があることを認識し理解するものとします。これを踏まえ、保有者は、本イベント前10日以内に、以下のいずれかに該当する場合には、保有者および同行者が本イベントに参加しないことに同意します:

a) 新型コロナウイルス感染症(COVID-19)もしくは他の感染症の検査で陽性または推定陽性が確認され、または新型コロナウイルス感染症(COVID-19)もしくは他の感染症の潜在的保菌者であることが確認された場合

b) 新型コロナウイルス感染症(COVID-19)またはその他の感染症に一般的に関連する症状を発症した場合

c) 新型コロナウイルス感染症(COVID-19)またはその他の感染症に感染していることが確認されている者、または感染の疑いがある者と直接接触または近接していた場合

本規約において「感染症」とは、新型コロナウイルス感染症(COVID-19)、その変異株または変異種、新型コロナウイルス感染症(COVID-19)を引き起こすコロナウイルス、および/またはその他の空気、エアロゾルまたは接触により伝播する感染性疾患、ウイルス、細菌または疾病もしくはその原因をいいます。

新型コロナウイルス感染症(COVID-19)およびその他の感染症に関するリスクの負担

保有者は、保有者自らのため、および同行者に代わり、競技会場において新型コロナウイルス感染症(COVID-19)またはその他の感染症に感染または暴露することに何らか関連しまたは起因するすべてのリスクを、明示的かつ任意に引き受けます。保有者は、自らのため、および関係者(本段落末尾に定義します。)に代わり、本チケットを使用することにより、保有者および/または同行者が新型コロナウイルス感染症(COVID-19)またはその他の感染症に暴露するリスクを理解し、かかるリスクを、現在および将来に亘って引き受けることを、確認し同意するものとします。保有者は、これらのリスクには、新型コロナウイルス感染症(COVID-19)またはその他の感染症に罹患すること、および新型コロナウイルス感染症(COVID-19)またはその他の感染症に罹患することによって生じる可能性のある危険、合併症、身体的および精神的傷害が含まれることを明示的に了解するものとします。加えて、保有者は、自らのため、および同行者に代わり、人々との交流には、新型コロナウイルス感染症(COVID-19)を含む感染症に暴露し、罹患するリスクが不可避的に伴うこと、保有者および/または同行者がこれに暴露しないことを保証できないこと、したがって、新型コロナウイルス感染症(COVID-19)またはその他の感染症に暴露し、罹患する可能性は、保有者の本チケット使用の決定に内在するリスクであり、そのリスクを排除することはできないことを理解し同意するものとします。 「関係者」とは、同行者、保有者および同行者の代理人、譲受人、相続人、近親者、その他これらの者のために権利を主張する権限を有する個人または団体をいいます。

けが、病気、および財産的損害のリスクの負担

保有者は、本イベントへの保有者および同行者の出席は任意であり、負傷、死亡、病気、財産的損害が発生する可能性があることを認識します。保有者は、すべての規則等に従うこと、保有者および同行者の周囲に注意を払い意識し続けることに同意します。本チケットを使用すること、または本イベントに出席、観覧、参加することにより、保有者は、自らのため、および関係者に代わり、以下に関連するすべてのリスクや危険を確認し、負担するものとします。(a)野球の試合(準備運動、練習、試合前・試合後・イニング間の活動・宣伝・競技を含みます。)の開始前、試合中、試合後 に観客でいること、(b)本イベントに出席、観覧、参加すること。なお、いずれの場合も、そのリスクや危険が、本イベントの開始前・途中・終了後に発生したかどうかにかかわりません。特に(これに限られませんが)、投げられたバット、バットの破片、投球または打球、投げられ、落とされまたは打ち上げられた物、発射物、人、動物、その他の危険や観戦の妨げになるもの、人が密集したことについて生じた事件や事故、他の観客の過失や違法行為により負傷する危険を含みます。保有者は、自らのため、および関係者に代わり、 (x)保有者または同行者の本イベントへの出席や観覧、および/または (y)免責当事者(本段落末尾に定義します。)の単独もしくは共同の過失、比較過失、無過失責任の結果として被った負傷、死亡、病気、財産的損害またはその他の損失(以下総称して「観客による請求」といいます。)につき、免責当事者が責任を負わないことに同意するものとします。「免責当事者」とは、(i)WBCI関係者、(ii)WBCI関係者のそれぞれの過去・現在・将来のライセンシー、スポンサーおよびベンダー、それらのすべての後継者および譲受人、(iii)その他すべてのWorld Baseball Classicの関係者、(iv)競技会場およびその所有者またはその運営者、(v)競技会場に関連するあらゆる政府機関、(vi)チケット販売・提供業者、(vii)これらの者の過去・現在・将来のすべての関連会社、承継人、譲受人、選手、監督、コーチ、従業員、パートナー、メンバー、取締役、役員、オーナー、代理人、代表者および業務委託先をいいます。

一般的な免責および不起訴の誓約

保有者は、自己のため、および関係者に代わり、A)本チケットの使用、B)競技会場への入場、C)本イベントまたは免責当事者が手配、宣伝または主催する関連活動への参加に関しまたは何らか関連して発生し得る、あらゆる種類または性質の法的な請求、責任または要求((i)全部または一部について、免責当事者の単独または共同の過失、比較過失、無過失責任の結果として生じる請求、(ii)会場に来場することに不可避的に伴う危険(a)観客による請求、b)保有者もしくは関係者または保有者もしくは関係者によって新型コロナウイルス感染症(COVID-19)もしくはその他の感染症に暴露したその他の個人による、負傷、不慮の死亡、新型コロナウイルス感染症(COVID-19)またはその他の感染症への感染または暴露を理由とするすべての請求、c)保有者または関係者に対するセキュリティの調査または選別、健康安全対策の適用に関するすべての請求、d)本イベントにおける保有者または同行者の映像または写真が掲載された広告、プロモーション、コンテンツ、プログラムその他の資料の制作、複製、配布、送信、公開、公演、放送、展示に起因するプライバシーの侵害、名誉毀損、パブリシティー権やプライバシー権の侵害またはその他の請求の原因に対する請求を含みます。)の結果として生じる請求を含みます。以下総称して「免責対象請求」といいます。)について、免責当事者に対して、その権利を放棄し、免責し、損害を与えず、訴訟を提起しないことを誓約するものとします。

本規約で定める請求放棄および免責についての同意および明示的な危険の負担は、拘束力のある完全な請求放棄および責任免除を意図したものであり、新型コロナウイルス感染症(COVID-19)またはその他の感染症への暴露または感染に関連して生じる可能性のある議論、請求または紛争に関するものも含めて、法律で認められる限りにおいて広く包括的に解釈されるものとします。本規約の一部が何らかの理由で無効または法的強制力がないものとされた場合(以下「該当条項」といいます。)であっても、本規約の残りの部分はその影響を受けず、有効かつ完全に強制力を持ち、該当条項も法律で認められる最大限の範囲内で強制力を持つものとします。

本イベントに出席または参加することにより、保有者は、自らのため、および関係者に代わって、法律で認められる最大限の範囲において、免責当事者に対して責任を完全に免除したものとみなされます。

未成年者その他の同行者が保有者とともに本イベントに出席する場合、保有者は、(a)未成年者の親もしくは保護者、または親もしくは保護者の正式な代理人として、その未成年者のために、 (b)その他の同行者の正式な代理人として、その同行者のために、前述のすべての権利の付与、免責および請求放棄を行ったものとみなされます。 (i) 保有者が、未成年者のためにそのような権利の付与、免責および権利放棄をする権限を有しない場合、または、そのような権利の付与、免責および権利放棄を希望しない場合、保有者は、当該未成年者とともにただちに会場から退出しなければなりません。また、(ii)保有者が、同行者のためにそのような権利の付与、免責および権利放棄をする権限がない場合、または、保有者がそのような権利の付与、免責および権利放棄を希望しない場合、当該同行者は、直ちに会場から退出しなければなりません。

保有者は、(i)免責対象請求、(ii)保有者または同伴者の作為または不作為、 (iii)保有者による本規約の条項、条件または表明の違反から生じる、またはそれらに付随もしくは何らか関連する要求、訴訟、請求、費用(合理的な弁護士報酬および費用を含みます。)および責任から、免責当事者を補償し、防御し、損害を与えないものとします。

保有者は、本規約において負担する補償義務および補償責任は、無制限かつその原因を問わないものとし、免責当事者の単独もしくは共同の過失、または競合過失(積極的か消極的かを問いません。)、無過失責任、潜在的な、明白な、または既存の欠陥または状態を含み、かつ、人員の入退場または貨物の積み下ろしに起因するあらゆる請求を含むことに同意するものとします。

試合のための競技場に立ち入ることその他本イベントを妨害すること、またはイベント参加者と身体的な接触を試みることは、懲役および/または罰金の対象となる犯罪です。違反したお客様は、法律の定める最大限の範囲において、訴追される可能性があります。

WBCIが本規約に違反したことにより保有者に損害が発生した場合には、保有者に対する損害賠償額の上限は、法令で認められる限りにおいて、購入申込み、購入または保有に係るチケットの券面額の総額とします。また、WBCI関係者は、保有者に対して、本規約の違反に起因する特別損害や間接損害、結果損害については責任を負いません。本規約に基づくWBCI関係者に対する上記の免責または責任制限は、かかる請求がWBCI関係者の重過失または故意の不法行為に起因する場合は適用されません。

強制仲裁合意および集団訴訟の放棄(以下「本仲裁合意」といいます)。

WBCI関係者は、ファンとの良好な関係を維持することを、とても大切にしています。お客様またはお客様の同行者が本チケットまたは本イベントに関して問題を抱えた場合、カスタマーサービスにお電話いただくことにより、問題を迅速かつ友好的に解決することができます。協議により解決されない紛争は、本仲裁合意に従って解決されなければなりません。

適用法令で禁止されている場合を除き、保有者およびWBCI関係者は、保有者による本チケットの購入もしくは保有者もしくは同行者による本チケットの使用、保有者もしくは同行者による本イベントへの参加、出席もしくは観覧、本規約または両者間の関連取引に関するあらゆる請求および紛争(保有者または同伴者の本イベントへの出席または参加に起因する疾病(新型コロナウイルス感染症(COVID-19)その他の感染症を含みます。)、身体的な負傷、財産的損害に関する請求を含みます。)(以下「仲裁請求」といいます。)を、仲裁により解決することに合意します。ただし、拘束力のある個別仲裁を通じた、仲裁合意の有効性、適用範囲または執行可能性に関する仲裁請求を除くものとします。

仲裁によって解決されるべき仲裁請求においては、保有者およびWBCI関係者は、裁判または陪審裁判を受けることができず、集団訴訟または集団仲裁に参加することができません。保有者およびWBCI関係者が裁判において有するであろうその他の権利は、上訴権を含め、仲裁では利用できず、またはより制限されることになります。保有者およびWBCI関係者は、すべての紛争を個別仲裁によって解決することを互いに要求することによって、それぞれが裁判または陪審裁判を受ける権利を放棄することを理解し同意するものとします。すべての紛争は、個々の仲裁により解決されるものとし、集団訴訟、代表訴訟、集団仲裁その他これらに類似の手続によらないものとします。仲裁人は、複数の当事者の請求を統合することはできないものとします。

仲裁は、WBCI が選定した高い評価を有する仲裁機関によって、競技会場が所在する都市において、上記の仲裁に適用されるルールに従って選ばれた一名を仲裁人として行われるものとします。仲裁人は、裁判所で得られるはずのすべての救済を裁定する権限を有するものとします。ただし、仲裁人の権限は、本規約に特に明記されている場合を除き、保有者およびWBCI関係者のみに対するものに限定されるものとします。いかなる仲裁判断も、当事者以外に対しては、優先的効力を有しません。仲裁人の仲裁判断は、最終的かつ拘束力を有するものとします。両当事者は、本仲裁合意が、仲裁請求に関与するすべての他の当事者(同伴者、関係者および免責当事者を含みます。)にも及ぶことに同意します。本仲裁合意が仲裁機関または仲裁人の規則と矛盾する場合、本仲裁合意が優先するものとします。

本契約の他の規定にかかわらず、保有者およびWBCI関係者は、それぞれ、暫定的な救済措置を求めるために法令に定めれた権利を行使することができますが、これにより仲裁の権利を放棄することにはなりません。本規約の他の規定にかかわらず、前述の集団訴訟の放棄および集団仲裁の禁止が無効または執行不能と判断された場合、本仲裁合意全体が無効となるものとします。集団訴訟の放棄および集団仲裁の禁止以外の本仲裁合意の一部が無効または執行不能と判断された場合でも、本仲裁合意の他の部分は無効とはなりません。本仲裁合意は、本規約の終了、本イベントの終了、または当事者の破産もしくは支払不能後も(適用法令で認められる範囲において)存続するものとします。

お客様は、本仲裁合意を拒否する権利を有しますが、かかる権利は速やかに行使されなければなりません。お客様が本仲裁合意に拘束されることを希望しない場合、お客様は、本イベントの開催日から30日以内に消印のある書面により、オプトアウト通知をWBCIに郵送して通知しなければなりません。ご要望は、「1271 Avenue of the Americas, New York, NY 10020」を住所とする「World Baseball Classic, Inc.」の「Legal Department」を宛先とし、タイトルを「Ticket Claim Notice」とした上で送付してください。ご要望では、お客様の氏名、住所を特定され、「I reject the Arbitration Agreement contained in my Event Ticket.」という文言が含まれていなければなりません。お客様が仲裁を拒否する権利を行使した場合、本規約の他の条項は、お客様が仲裁を拒否しなかった場合と同様に、完全に効力を有するものとします。

本仲裁合意に基づき請求を行う前に、請求者は、相手方当事者に仲裁請求の書面による通知(以下「請求通知」といいます。)を送付し、仲裁請求を解決するための30日を下らない合理的な機会を与えるものとします。WBCI関係者の1つ以上に対するあらゆる請求通知は、「1271 Avenue of the Americas, New York, NY 10020」を住所とする「 World Baseball Classic, Inc.」の「Legal Department」を宛先とし、タイトルを「Ticket Claim Notice」とした上で郵送してください。あらゆる請求通知は、a)氏名、住所、電子メールアドレス、電話番号によって請求者を特定し、b)仲裁請求の性質と要求する救済を説明し、c)請求者のみのために提出するものとし、他のいかなる当事者のためにも提出してはなりません。請求者は、相手方当事者が仲裁請求に関する情報の提供を求めたときはこれに合理的な範囲で協力し、相手方当事者に救済要求に応答する合理的な機会を与えなければなりません。

未成年者その他の同行者が保有者とともに本イベントに出席する場合、保有者は、(a)未成年者の親もしくは保護者、または親もしくは保護者の正式な代理人として、その未成年者のために、(b)その他の同行者の正式な代理人として、その同行者のために、本仲裁合意に同意したものとみなされます。 (i)保有者が当該未成年者のためにそのような合意をする権限を有しない場合、または、保有者がそのような合意を希望しない場合、保有者は、当該未成年者とともにただちに会場から退出しなければなりません。(ii)保有者がその他の同行者のためにそのような合意を付与する権限がない場合、または、保有者がそのような合意を希望しない場合、当該同行者は直ちに会場から退出しなければなりません。

注意事項

すべてのイベントの時間は変更される可能性があります。WBCI関係者は、チケットの紛失、盗難、複製について責任を負いません。

本チケットは、本イベントが終了するまで大切に保管してください。本チケットの紛失、盗難、破損の場合でも、本チケットの交換はできません。本チケットは本イベントのみに有効であり、チケット保有者が本チケットを本イベントに使用できなかったことを理由として購入代金のいかなる部分も返金されることはありません。本イベントが実施または完了されず、WBCIが独自の判断で競技会場において本イベント(またはその一部)の再スケジュールまたは再開(以下「振替イベント」といいます。)を選択した場合、チケット保有者は、WBCIの独自の判断で発表しhttps://www.mlb.com/world-baseball-classic に掲載された振替イベントの実施日時に、本チケットによって振替イベントに参加できるものとします。また、保有者が本チケットを振替イベントに使用できなかったことを理由として、購入代金のいかなる部分も返金されることはありません。

本イベント(またはその一部)が、a)競技会場でキャンセルされ、再スケジュールされない場合、b)公認野球規則7.01に基づく有効試合(以下「有効試合」といいます。)を構成する時点まで進行せず、競技会場で再開されない場合、c)無観客または限られた観客のみで行われた場合は、WBCI関係者は払戻しの実施の有無をその独自の判断により決定し、その決定内容を https://www.mlb.com/world-baseball-classic で公表するものとします。

本イベントが有効試合を構成する時点まで進行した場合、払戻しは行われません。

IMPORTANT: THIS TICKET IS A REVOCABLE LICENSE;

HOLDER VOLUNTARILY ASSUMES RISK OF ILLNESS/INJURY; NO RE-ENTRY UPON EXIT; THIS TICKET LIMITS HOLDER’S LEGAL RIGHTS

By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE And A class action waiver. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at https://www.mlb.com/world-baseball-classic will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).

COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.

Holder agrees that: a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all legitimate purposes including without limitation broadcasting, transmitting and promoting the Event by the WBCI Entities, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.

Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which, due to the evolving nature of the COVID-19 pandemic and other matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities. Holder acknowledges that to the extent permitted by law, the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).

The WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: a) violates the terms of the Agreement, including without limitation any Policy; b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; c) appears to be or is intoxicated; d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; e) uses vulgar or abusive language; or f) poses a risk to the health or safety of others.

Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may receive a fine.

Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation a) terms that mandate or prescribe the quantity of tickets available to be purchased, b) additional requirements regarding Accompanying Parties, and c) terms regarding the resale or transfer of tickets.

FAN HEALTH PROMISE

Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, within ten (10) days preceding the Event, they have:

a) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR

b) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR

c) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.

A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.

ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES

Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.

ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE

Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) the sole, joint, or comparative negligence, or strict liability, of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.

GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE

ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, A) USE OF THIS TICKET, B) PRESENCE AT THE HOST VENUE OR C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION a) ALL SPECTATOR CLAIMS; b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).

The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.

BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.

HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF ANY RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.

ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT MAY BE PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.

MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)

The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.

Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.

In any Arbitration Claim to be resolved by arbitration, neither Holder nor the WBCI Entities will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and the WBCI Entities would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.

Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.

Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).

YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.

Prior to bringing a claim under this Arbitration Agreement, the Claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must a) identify the Claimant by name, address, email address, and telephone number; b) explain the nature of the Arbitration Claim and the relief demanded; and c) be submitted only on behalf of the Claimant, and not on behalf of any other party. The Claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.

IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY ACCOMPANYING MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.

NOTICE

ALL EVENT TIMES ARE SUBJECT TO CHANGE. THE WBCI ENTITIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.

Retain possession of this ticket until the Event has been completed. This ticket cannot be replaced if lost, stolen or destroyed. This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at https://www.mlb.com/world-baseball-classic. No part of the purchase price will be refunded by reason of the failure of Holder to use this ticket for the Rescheduled Event.

Should the Event (or any portion thereof) a) be canceled and not rescheduled at the Host Venue, b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or c) be played without fans, or with limited fans, in attendance, the WBCI Entities will determine in their sole discretion whether any refunds will be issued and post such decision at https://www.mlb.com/world-baseball-classic.

Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

持票人使用本票券即表示持票人(代表自己及同行之任何未成年人,合稱「持票人」)同意接受下列條款及條件(下稱「本合約」),包括同意仲裁及不提起團體訴訟之條款。World Baseball Classic, Inc.(下稱「WBCI」)得隨時變更本合約條款(下稱「更新版合約」),不待另行通知。在WBCI於https://www.mlb.com/world-baseball-classic 公告更新版合約後,持票人使用本票券即代表持票人同意接受更新版合約。持票人應自行負責於使用本票券前詳閱及瞭解本合約。為免疑義,本合約中關於持票人同意採取或不採取特定行動或授予特定權利之各項條款,均應且確實對持票人及同行之未成年人有拘束力,持票人應促使同行之未成年人採取或不採取該等行動並授予該等權利;為此,持票人代表自己及同行之任何未成年人,同意持票人及該等未成年人將採取或不採取該等行動或將授予該等權利(依情況適用)。

新冠肺炎是極具傳染性的疾病,可導致重大疾病甚至死亡。無論採取何種預防措施,任何公共場所均存在接觸新冠肺炎的固有風險。持票人,代表自己及任何陪同人(定義詳下),同意:(a) 承擔所有與新冠肺炎及其他傳染病相關之風險;及 (b) 遵守一切相關之WBCI健康及安全政策

持票人同意:a) 持票人絕不在任何媒體上,傳輸或協助傳輸本票券授予入場資格的比賽(下稱「本球賽」)或為本球賽舉辦的任何相關娛樂活動、花絮、熱身、練習、賽前活動、賽後活動或局間活動、宣傳活動、競賽或任何其他活動(與本球賽合稱「本活動」)之全部或一部的任何照片、影像、影片、音訊、現場直播或其他敘述或描述(包括實況數據)(無論以文字、數據或是視覺形式呈現),包括但不限於任何關於本球賽或其他活動(合稱「球賽資訊」)之敘述、描述、照片/圖片、影片、音訊、重製或其他資訊;b) WBCI為本球賽及球賽資訊之所有著作權及其他專有權之獨家所有人;以及 c) WBCI、美國職業棒球大聯盟主席辦公室(Office of the Commissioner of Baseball)、MLB Advanced Media, L.P.、The MLB Network, LLC、美國職業棒球大聯盟球隊、Major League Baseball Properties, Inc.、參與世界棒球經典賽(World Baseball Classic)的各國棒球總會、球員及其他個人,美國職業棒球大聯盟球員協會(Major League Baseball Players Association)、MLB Players, Inc.,及其各自之過去、現在及未來子公司、關係企業、代理人、經理人、員工、成員、董事及所有人(合稱「WBCI成員」),以及WBCI成員現在及未來特定贊助商及被授權人,擁有不受限制之權利及授權,可以在全球且永久為一切合法目的(包括但不限於由WBCI成員進行本活動之廣播、播送及推廣),於任何及所有現在已知或未來出現之媒體上,無償於任何為本活動製作之直播或預錄電台節目、電視節目、照片、影片、音訊、影音及/或其他紀錄,或本活動全部或一部之其他播送、發布、公開演出或重製中,使用持票人之形象、肖像、姓名、聲音、評論及/或其他專有或公開權利。本合約下授予WBCI成員之權利可以轉讓。

持票人代表自己及任何陪同人(定義詳本條末):(a) 同意為安全目的而對持票人及/或任何陪同人之人身、行李、衣物或其他物品進行安全搜查、過濾及/或檢查,包括透過門框型或掌上型金屬探測器、行李檢查或其他方式進行:及 (b) 肯認並同意遵守:(i) 任何WBCI成員發布之所有相關政策及程序,包括但不限於任何關於安全、行李、粉絲行為及/或健康與安全之政策及程序(下稱「WBCI政策」);因新冠肺炎全球疫情及其他與健康、安全、安全等相關事宜之不確定性,在您購買本票券及本活動日期之間,上述政策可能會持續隨時更新;及 (ii) 國家及地方主管機關之所有適用法律、命令及政策。持票人確認,於法律許可範圍內,WBCI成員對持票人及/或任何陪同人之人身或財產不承擔任何責任。「陪同人」係持票人為其持有一張門票並與持票人一起參加本活動之任何同行者(不包括同行未成年人)(且持票人聲明已獲陪同人授權代表其接受適用之本合約條款)(合稱「陪同人」)。

若持票人及陪同人發生下列情況,WBCI成員有權在不退還任何購票價金之情況下,撤銷本票券授予之任何或一切授權,並拒絕持票人及陪同人參與本活動或要求其離開本活動:a) 違反本合約條款,包括但不限於任何WBCI政策;b) 持有WBCI成員認為對其他觀眾有潛在危險、危害、不適當及/或傷害之任何物品或物體(合稱「禁止物品」),且任何禁止物品均得被沒收;c) 有酒醉跡象或實際酒醉;d) 從事任何WBCI成員認為不適當、脫序或不得體的行為;e) 使用粗俗或辱駡性語言;或 f) 對他人之健康或安全造成風險。

持票人若向WBCI或其指定代理人以外之任何人購買本票券,所有風險由持票人自行承擔。未經WBCI明示書面同意,本票券不得用於廣告、宣傳(包括競賽及抽獎)或其他貿易或商業目的。在法律或法規禁止或違反WBCI政策的情況下,不得兜售或轉售本票券。這種轉售行為將使本票券授予之權利失效。不得在本活動場館(包括球場、周邊區域及停車場,合稱「活動場館」)內兜售或轉售本票券;任何在活動場館內以任何價格兜售或轉售本票券之人,將被要求離開活動場館並可能遭到罰款。

持票人(代表自己及任何陪同人)同意遵守本票券購買當時之所有條款及條件,包括但不限於:a) 授權或約定可購買門票數量之條款;b) 關於陪同人的進一步規範;以及 c) 關於票券轉售或轉讓之條款。

粉絲健康承諾

持票人肯認並瞭解,若感染新冠肺炎或其他傳染病(定義詳本條末),持票人及/或任何陪同人可能會感染後續接觸之人,即使未經歷或出現任何疾病症狀亦然,且接觸他人之風險無論何時均存在。因此,持票人同意,持票人或任何陪同人若於本活動前十(10)日內有下列情況,即不應參加本活動:

a) 新冠肺炎或其他傳染病檢測呈陽性或推定為陽性,或被認定為新冠肺炎或其他傳染病之潛在攜帶者;或

b) 出現過任何一般與新冠肺炎或其他傳染病相關之症狀;或

c) 曾直接接觸或緊鄰任何經確認或懷疑感染新冠肺炎或其他傳染病之人。

本合約稱「傳染病」係指新冠肺炎,其任何菌株、變種或突變,導致新冠肺炎之冠狀病毒,及/或任何其他透過空氣傳播、氣溶膠或表面傳播之傳染病、病毒、細菌或疾病或其原因。

承擔與新冠肺炎及其他傳染病相關之風險

持票人(代表自己及任何陪同人)肯認並明示自願承擔透過任何方式與在活動場館遭暴露或接觸新冠肺炎或其他傳染病相關或因其產生之所有風險。持票人使用本票券即表示持票人代表自己及任何關係人(定義詳本條末)肯認並確認,持票人現在及未來均瞭解並明示同意承擔持票人及/或任何陪同人可能接觸新冠肺炎或其他傳染病之風險。持票人明確瞭解,該等風險包括感染新冠肺炎或其他傳染病,及因感染新冠肺炎或其他傳染病而可能導致之相關危險、醫療併發症及身體及精神傷害,包括可預見及無法預見者皆然。持票人進一步代表自己及任何陪同人聲明其肯認及瞭解,與公眾之任何互動均會帶來接觸及感染傳染病(包括但不限於新冠肺炎)之固有風險,無法保證持票人及/或任何陪同人不被感染。因此,新冠肺炎或其他傳染病之潛在暴露或感染為持票人決定使用本票券之固有且無法排除的風險。「關係人」係指任何陪同人及持票人及任何陪同人之個人代表、受讓人、繼承人、直系親屬及任何其他可能有權代表其提出請求之個人或實體。

承擔人身傷害、疾病及/或財產損失之風險

持票人確認,持票人及任何陪同人均為自願參加本活動,且本活動可能導致人身傷害(包括死亡)、疾病及/或財產損失。持票人同意遵守所有WBCI政策,並對持票人之周圍環境及任何陪同人之周圍環境保持警覺及注意。一旦使用本票券或出席、觀看或參與本活動,即表示持票人(代表自己及任何關係人)肯認並承擔所有與下列相關之風險及危險:(a)於棒球比賽開始之前、期間及之後擔任觀眾(包括所有熱身、練習、賽前、賽後及局間活動、宣傳及比賽);及 (b) 出席、觀看或參與本活動;於前述各種情況下,無論是在該等風險或危險發生之前、期間或之後,特別包括(但不限於)遭拋出的球棒、球棒碎片、遭拋出或打擊之棒球、被拋出、掉落或發射的物品、投射物、人、動物、其他危險或干擾所傷害的危險,以及與人群或其他觀眾之疏失或不當行為相關之任何事件或事故。持票人(代表自己及任何關係人)同意受豁免方(定義詳本條末)毋須為任何因下列事由造成的人身傷害(包括死亡)、疾病、財產損失或其他損失(合稱「觀眾請求」)負責:(x) 持票人及/或任何陪同人參與、出席及/或觀看本活動;及/或 (y) 任何受豁免方之單獨、共同或比較過失或嚴格責任。「受豁免方」係指:(i) WBCI成員;(ii) WBCI成員各自之過去、現在及未來之被授權人、贊助商及廠商,及其所有繼受者及受讓人;(iii) 所有其他世界棒球經典賽(World Baseball Classic)相關成員;(iv) 活動場館及其所有人及/或營運商;(v) 任何與活動場館相關之政府機關;(vi) 門票廠商及/或供應商;及 (vii) 前述成員之所有過去、現在及未來之關係企業、繼受者、受讓人、球員、經理、教練、員工、合作夥伴、成員、董事、經理人、所有人、代理人、代表及獨立承包商。

責任概括豁免及不提出訴訟之承諾

持票人代表自己及任何關係人,茲此就任何因下列事由造成、與其相關或以任何方式有任何連結之任何類型或性質的請求、責任或要求,拋棄其相關權利,豁免及解除受豁免方之相關責任,並承諾不就此向受豁免方提出訴訟:a) 本票券之使用;b) 進入活動場館;或 c) 參與本活動或任何由豁免方安排、推廣及/或贊助之相關活動,包括但不限於因下列事由造成的請求:(i) 受豁免方單獨、共同或比較過失或嚴格責任(全部或部分);及/或 (ii) 與進入活動場館相關之固有風險,包括但不限於:a) 所有觀眾請求;b) 由持票人、任何陪同人,或其他因持票人或任何陪同人而接觸到新冠肺炎或其他傳染病之個人,就人身傷害、不當致死、接觸或感染新冠肺炎或其他傳染病提出的所有請求;c) 與對持票人及/或任何陪同人實施任何安全搜索或檢查或任何健康及安全保護程序相關的所有請求;及/或 d) 所有因製作、重製、發布、傳播、出版、公開表演、廣播或展示其中含有持票人或任何陪同人之本活動錄音/錄影/紀錄或照片的廣告、宣傳、內容、節目及/或素材而引起之侵害隱私權、誹謗、侵害任何公開權、隱私權利或任何其他原因之請求(合稱「受豁免請求」)。

本合約所載之確認事項、明示風險承擔、請求權拋棄及責任豁免,均具有拘束力,且屬完整權利之拋棄及完整責任之豁免,且應於法律許可範圍內以廣義且兼容的方式解釋,包括與新冠肺炎或其他傳染病之接觸或感染相關之任何糾紛、請求或爭議。若本合約之任何部分因任何事由被認定為無效或於法律上無法執行(下稱「受影響條款」),本合約之其餘部分不受影響,應維持有效且可完全執行,受影響條款應於法律允許之最大範圍內執行。

持票人一旦出席及/或參與本活動,持票人(包括自己及任何關係人)即被視為已於法律許可之最大範圍內,完全免除受豁免方之責任。

若未成年人及/或其他陪同人與持票人一起參加本活動,持票人將被視為代表以下人士授予、豁免及拋棄上述所有權利:(a) 代表未成年人(持票人為父母或監護人或其父母或監護人之授權代理人);及/或 (b) 代表其他陪同人(持票人為其授權代理人)。若持票人不願意或未被授權代表未成年人授予、豁免及拋棄上述所有權利,持票人應立即與未成年人一起離開活動場館;若持票人不願意或未被授權代表其他陪同人授予、豁免及拋棄上述所有權利,該等陪同人應立即離開活動場館。

若受豁免方因下列事由而產生任何要求、訴訟、請求、費用(包括合理之律師費及開支)、開支及責任,持票人應向其提供賠償、為其抗辯,使其不因此受任何損害:(i) 受豁免請求;(ii) 持票人及/或任何陪同人之作為或不作為;或 (iii) 持票人違反本合約任何條款、條件或聲明引起、造成或與其相關之責任。

持票人同意,於本合約下承擔之賠償義務及責任不受任何限制,亦不考量其原因,包括任何受豁免方單獨、共同或混合過失(無論是主動或被動),嚴格責任,隱蔽、明顯或預先存在之瑕疵或情況,包括任何因人員或貨物之進入、退出、裝載及卸載而產生之請求。

進入比賽場地、以其他方式干擾活動,及/或試圖與活動參與者進行任何身體接觸,可能被處以罰款及/或監禁。違反者在法律許可之最大範圍內可能遭到起訴。

強制性仲裁協議及團體訴訟權利之拋棄(下稱「仲裁協議」)

WBCI成員非常重視與粉絲維持良好關係。若您或您的任何陪同人對本票券或本活動有任何問題,撥打客服專線即可迅速順利解決問題。任何無法以非正式方式解決之爭議,均必須依據本仲裁協議解決。

除非相關法律禁止,持票人及WBCI成員同意以具拘束性之個別仲裁解決任何及有與下列事由相關之請求及糾紛:持票人購買或持票人或任何陪同人使用本票券、持票人及/或任何陪同人參與、出席及/或觀看本活動、本合約,及雙方間之任何相關交易,包括但不限於因持票人及/或任何陪同人出席及/或參與本活動而造成的疾病(包括新冠肺炎或其他傳染病)、身體傷害或財產損失之請求(下稱「仲裁請求」),惟不含關於本仲裁協議之有效性、範圍或可執行性之仲裁請求。

在任何透過仲裁解決之仲裁請求中,持票人及WBCI成員均不應選擇法院或陪審團程序,或參與團體訴訟或團體仲裁。在仲裁程序中,持票人及WBCI成員在法院程序中擁有的其他權利(包括上訴權利)將不存在或受到限制。持票人及WBCI成員各自瞭解並同意,透過要求他方採用個別仲裁解決所有爭議,雙方各自拋棄選擇法院或陪審團程序之權利。所有爭議均應以個別案件為基礎進行仲裁,不得採用團體訴訟、代表訴訟、團體仲裁或任何類似程序。仲裁人不得合併多方當事人的請求。

仲裁應由WBCI選擇具良好聲譽之仲裁機構實施。仲裁應於活動場館所在之城市進行。仲裁應由一名仲裁人主持,該仲裁人應依據上述仲裁規則進行選擇。仲裁人有權授予任何可於法院程序取得的救濟,除本合約另有約定外,仲裁人權力範圍僅限於持票人及WBCI成員。任何仲裁決定均不會對非當事人產生任何對其有妨礙性之影響。仲裁人之決定應具終局性且具拘束力。雙方同意,本仲裁協議對任何仲裁請求涉及之任何其他當事人亦有適用,包括但不限於任何陪同人、關係人及/或受豁免方。若本仲裁協議與仲裁機構或仲裁人規則之間有任何歧異,應以本仲裁協議為準。

縱令本合約有任何其他約定,持票人及WBCI成員均得行使任何合法之權利以尋求臨時救濟,而不會因此拋棄仲裁權利。縱令本合約有任何其他約定,若上述團體訴訟權利之拋棄及禁止團體仲裁之約定,被認定為無效或無法執行,則仲裁協議整體將成為無效。若本仲裁協議中拋棄團體訴訟權利及禁止團體仲裁以外的任何約定被認定為無效或無法執行,則不應使本仲裁協議之其餘部分成為無效。本仲裁協議將於本合約終止、本活動終了及/或一方破產或成為無支付能力後繼續有效(於適用法律許可範圍內)。

您有權拒絕接受本仲裁協議,但您必須立即行使此權利。若您不同意受本仲裁協議之拘束,您必須於本活動日期後三十(30)日內郵寄書面異議來通知我們。您必須將您的請求寄至:World Baseball Classic, Inc.;收件人:法務部門;主旨:票務仲裁;地址:1271 Avenue of the Americas, New York, NY 10020。該請求必須記載您的全名、地址及「本人拒絕接受活動票券所載仲裁協議」之聲明。若您行使拒絕仲裁之權利,本合約之其他條款仍應完全有效,如同您未拒絕仲裁一般。

在依據本仲裁協議提出請求之前,請求人應向他方當事人發出仲裁請求之書面通知(下稱「請求通知」)並向其提供合理機會,使其至少有三十(30)日時間解決仲裁請求。任何對一家或多家WBCI成員提出的請求通知,應郵寄至:World Baseball Classic, Inc.;收件人:法務部門;主旨:票務請求通知;地址:1271 Avenue of the Americas, New York, NY 10020。任何請求通知均必須:a) 透過提供請求人之姓名、地址、電子郵件地址及電話號碼,確認請求人身分;b) 說明仲裁請求之性質及所要求之救濟;及 c) 僅得代表請求人提交,不得代表任何他方當事人。請求人必須合理配合提供他方當事人就仲裁請求所合理要求的任何資訊,且必須給予他方當事人合理機會來回應救濟要求。

未成年人及/或其他陪同人與持票人一起參加本活動時,持票人將被視為(a)代表該未成年人同意接受本仲裁協議(持票人為父母或監護人或父母或監護人之授權代理人);及/或 (b)代表其他陪同人同意接受本仲裁協議(持票人為授權代理人)。若持票人不願意或未被授權代表未成年人同意接受本仲裁協議,持票人應立即與該未成年人一起離開活動場館;若持票人不願意或未被授權代表其他陪同人同意接受本仲裁協議,陪同人應立即離開活動場館。

注意事項

所有活動時間均可能進行變更。WBCI成員不對票券之滅失、遭竊或複製負責。

請於本活動結束前保留本票券。本票券如遇滅失、遭竊或損毀恕不補發。本票券僅適用本活動,持票人不得因為沒有在本活動使用本票券而請求退還任何購票價金。若本活動沒有舉行或完成,而WBCI依其全權酌情選擇於活動場館重新安排或繼續本活動(或其任何部分)(下稱「改期活動」),本票券允許持票人於改期活動之日期與時間參加改期活動,改期活動將依據WBCI全權酌情決定並公告於 https://www.mlb.com/world-baseball-classic 。持票人不得因為沒有在改期活動使用本票券而請求退還任何購票價金。

若本活動(或其任何部分)a) 被取消,且未於活動場館重新安排舉行;b) 未進行至或超過官方棒球規則(Official Baseball Rule)第7.01條所載構成正規比賽(下稱「正規比賽」)之時間點,且未於活動場館繼續進行;或 c) 在沒有觀眾或僅有有限觀眾出席的情況下進行,WBCI成員將依其全權酌情決定是否退款,並將決定公告於 https://www.mlb.com/world-baseball-classic

若本活動進展至或超過構成正規比賽之時間點,將不予退款。
