Ticket Back Terms and Conditions
IMPORTANT – Ticketholder agrees that: (a) he or she shall not transmit or aid in transmitting any photographs, images, videos, audio, reproductions, livestreams, or other accounts or descriptions (including play-by-play data), in any media or in any form, of all or any part of the event or related activities (the “Event Information”) without the express written consent of the event operator; (b) he or she does not own any copyrights or other rights in the event, related activities, or Event Information; and (c) his or her name, image, likeness, voice, portrait, and picture may be used in any broadcast, telecast, photograph and/or video and/or audio sound recording taken in connection with the event for all purposes. This ticket may not be used for advertising, promotion (including contests and sweepstakes) or other trade or commercial purposes without the express written consent of the event operator.
The license granted by this ticket is revocable and may be terminated by the event or venue operator at any time. All ticketholders are subject to seat relocation. No refund will be made on this ticket except as provided hereon. Tickets are subject to non-refundable service charges.
Any resale or attempted resale of this ticket in violation of applicable law violates the license granted by this ticket. Lost, stolen or counterfeit tickets, as well as duplicate, cancelled or invalidated tickets as a result of resale, transfer or otherwise, will not be honored. In New York: This ticket may not be resold within one thousand five hundred feet from the physical structure of this place of entertainment under penalty of law.
Prohibited items include, but are not limited to: items larger than 16”x16”x8”; hard sided coolers; cans; glass bottles; hard plastic, metal or open beverage containers (except those that are empty, individual-sized, and reusable); aerosol cans; commercial audio/visual equipment; alcoholic beverages; controlled or illegal substances; laser pointers; noisemaking devices; fireworks; animals (except for service animals); and weapons. Ticketholder consents to a reasonable search for prohibited items. Backpacks are prohibited at Citi Field. The venue retains the right to determine what items are deemed appropriate for entry. ASSUMPTION OF RISK RELATED TO PERSONAL INJURY AND/OR PROPERTY DAMAGE
WARNING – The ticketholder assumes all risk, danger and injury incidental to the game of baseball or other event and all warm-ups, practices, competitions, entertainment and promotions associated therewith, at all locations in and around the ballpark and surrounding areas and parking lots, whether occurring prior to, during or subsequent to the playing of the game or other event, including (but not limited to) the danger of thrown bats, fragments thereof, and thrown, propelled or batted balls and other objects, and agrees that no persons or entities (including but not limited to Sterling Mets, L.P. and its affiliates (collectively, “Club”), Brooklyn Baseball Company, L.L.C., Community Baseball Club of Central New York, Inc., the City of New York, NYCIDA, St. Lucie County, Onondaga County, the participating Clubs, and their respective agents, owners, officers, employees, affiliates and contractors) are liable for any injuries, death, or loss of property resulting from such causes, and releases and holds harmless all such persons and entities. Any guest concerned with their seat location should contact any guest service representative for an alternative seat location. The use of abusive language, interference with or disruption of the event (including but not limited to throwing objects in the stands or onto the field) or others’ enjoyment thereof, entry onto the playing area, and drunken or disorderly behavior, among other things, are prohibited. Violators are subject to ejection, civil penalties, and/or arrest. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY MINORS AND ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE CLUB AND THE BALLPARK OWNER/OPERATOR, AS WELL AS AGREE TO ALL OTHER TERMS AND RULES SET FORTH AT METS.COM/TICKETBACK, BROOKLYNCYCLONES.COM/TICKETBACK, SYRACUSEMETS.COM/TICKETBACK OR STLUCIEMETS.COM/TICKETBACK, AS APPLICABLE.
RAIN CHECK NOTICE – In New York: IF THE EVENT TO WHICH THIS TICKET APPLIES IS CANCELLED OR RESCHEDULED, THE TICKET DISTRIBUTOR SHALL NOT BE REQUIRED TO REFUND THE TICKET PRICE IF THE TICKET HOLDER IS GIVEN THE RIGHT, WITHIN TWELVE MONTHS OF THE ORIGINALLY SCHEDULED DATE OF THE EVENT, TO ATTEND A RESCHEDULED PERFORMANCE OF THE SAME EVENT OR TO EXCHANGE THIS TICKET FOR A TICKET COMPARABLE IN PRICE AND LOCATION TO ANOTHER, SIMILAR EVENT. EVENT DATE AND TIME ARE SUBJECT TO CHANGE
The ticket holder (“Holder”), on their behalf and on behalf of any accompanying minor (“Minors”) and any other accompanying party for whom Holder retains a ticket to attend the game or event governed by these terms (“Event”) with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable ticket terms) (“Accompanying Parties”), acknowledges and agrees to comply with (1) all relevant policies and protocols issued by the Club and/or the owner/operator of the ballpark, stadium or surrounding grounds or parking areas, to which the ticket provides access (“Ballpark”), including, without limitation, any policies and protocols regarding security, bags, fan conduct and health and safety, currently available at mets.com, brooklyncyclones.com, syracusemets.com or stluciemets.com, as applicable, all of which, due to the evolving nature of the COVID-19 pandemic, may continue to be updated from time to time between purchase of this ticket and the Event date, and (2) all current guidance of the Centers for Disease Control and Prevention and all applicable laws and policies of federal, state, city and local authorities.
FAN HEALTH PROMISE
Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder, any Minors and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder, any Minor nor any Accompanying Party will attend the Event if within fourteen (14) days preceding the Event, they have:
(1) tested positive or presumptively positive for COVID-19 or other Communicable Disease or been identified as a potential carrier of COVID-19 or other Communicable Disease; OR
(2) experienced any symptoms commonly associated with COVID-19 or other Communicable Disease; OR
(3) been in direct contact with or the immediate vicinity of any person who is confirmed or suspected of being infected with COVID-19 or other Communicable Disease.
A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.
RESALE TERMS AND POD INTEGRITY
Holder, on their behalf and on behalf of any Minors and Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase not specifically enumerated herein, including without limitation (1) terms that mandate or prescribe the quantity of tickets available to be purchased, (2) additional requirements regarding Accompanying Parties, and (3) terms regarding the resale or transfer of tickets.
ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES
Holder, on their behalf and on behalf of any Minors and Accompanying Parties, acknowledges and expressly assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Ballpark. By using this ticket, Holder is acknowledging and confirming, both now and in the future, that Holder understands and expressly assumes the risk that Holder, any Minor and any Accompanying Party may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands that any interaction with the general public poses an elevated, inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19, that it cannot be guaranteed that Holder, any Minor or any Accompanying Party will not be exposed, and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket that cannot be eliminated.
RELEASE OF LIABILITY AND COVENANT NOT TO SUE
HOLDER, ON BEHALF OF HOLDER, ANY MINOR, ANY ACCOMPANYING PARTY AND Holder’s, ANY MINOR’S AND any Accompanying Party’s personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on Holder’s, ANY MINOR’S or any Accompanying Party’s behalf, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE Sterling Mets, L.P. and its affiliates, Brooklyn Baseball Company, L.L.C., Community Baseball Club of Central New York, Inc., the City of New York, NYCIDA, St. Lucie County, Onondaga County, THE Club and the other Major League Baseball Clubs (“Clubs”), MLB Advanced Media, L.P., the Office of the Commissioner of Baseball (“BOC”), Major League Baseball Properties, Inc., The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities (THE “RELEASED PARTIES”) WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE BALLPARK OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (1) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (2) THE INHERENT RISKS ASSOCIATED WITH VISITING THE BALLPARK, INCLUDING, WITHOUT LIMITATION (X) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY MINOR, ANY ACCOMPANYING PARTY OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY MINOR, OR ANY ACCOMPANYING PARTY; AND (Y) ALL CLAIMS IN CONNECTION WITH THE APPLICATION OF ANY HEALTH AND SAFETY PROTOCOLS TO HOLDER, ANY MINOR, OR ANY ACCOMPANYING PARTY.
HOLDER FURTHER ACKNOWLEDGES AND AGREES THAT HOLDER IS FAMILIAR WITH AND DOES HEREBY WAIVE THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE (AND SIMILAR PROVISIONS OF OTHER JURISDICTIONS) WHICH PROVIDES AS FOLLOWS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”
The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of these terms and conditions shall not be affected thereby and shall remain valid and fully enforceable.
