Hometown Heroes Terms & Conditions

The Baseball Club of Seattle, LLLP (the "Mariners") is accepting nominations for its Hometown Heroes Program ("Program"). The Program honors and recognizes community heroes of our greater Pacific Northwest and beyond who have distinguished themselves by selflessly working or volunteering to help others during the COVID-19 pandemic in fields that care for, serve, teach, protect, and/or have generally improved the lives of others. To submit a nomination, a nominator must be a legal resident of the United States (including its commonwealths, territories, and possessions) or Canada (excluding the Province of Quebec) and the legal age of majority in his/her/their jurisdiction (and at least 18 years of age) at the time of the nomination submission. The Program is subject to all applicable federal, state, territory, provincial and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.

The Mariners will evaluate all eligible nominations in consideration of its selection of eligible nominees who are most worthy of receiving a Program Award. The Mariners will select one (1) potential eligible nominee most deserving of receiving a Program Award ("Potential Honoree") during each Mariners home game during the 2021 regular season during the Entry Period (defined below); however, the Mariners reserve the right to not award any Awards if they do not receive a sufficient number of eligible or qualified nominations as determined in their sole discretion. Subject to verification of eligibility of both the Potential Honoree and the nominator who nominated such Potential Honoree, the Potential Honoree will be declared an official Honoree of the Program. Eligible nominations will be evaluated based on the following criteria: How the nominee bettered life for those in his/her/their community, and how the nominee best reflects the principles of volunteerism, heroism, and/or philanthropy. All eligible nominations will remain eligible throughout the Entry Period.

Nominators may submit nominations online only by completing the online form during the Entry Period, which shall be from April 16, 2021 through September 30, 2021. Nominations must be submitted in the English language. All nominations must include a valid email address for the nominator. Nominators must fully complete and submit all non-optional data requested on the nomination form for their nominations to be eligible. Incomplete and/or inaccurate nominations are void. Nominators may be given the option to receive (a) commercial email from Mariners and/or MLB and/or (b) mobile text messages and updates from Mariners or MLB; however, eligibility to submit a nomination is not dependent upon nominator’s consent to receive such emails and/or mobile text messages and updates and consenting to receive such emails and/or mobile text messages and updates will not impact the opportunity to be selected. Standard messaging rates apply to mobile text messages and updates. Check with your mobile service provider for more information.

Online nominations must not exceed three hundred (300) words in length. All information submitted by nominators online is subject to, and will be treated in a manner consistent with, MLB's Terms of Use (accessible at mlb.com/tou) and Privacy Policy (accessible at mlb.com/privacy).

Self-nominations will be accepted. In order to submit a nomination which is not a self-nomination, nominator must have permission from the person he/she/they is nominating (or, if such person is under the legal age of majority in the jurisdiction in which he/she/they reside ("Minor Nominee"), must be the Minor Nominee's parent or legal guardian). The Mariners in their sole discretion, may require nominator to verify such permission before awarding an Award.

Honorees (or if Honoree is a Minor Nominee, such Minor Nominee's parent or legal guardian) will each receive four (4) tickets for one (1) Seattle Mariners 2021 regular season home game determined by the Mariners in their sole discretion, one (1) parking pass for use at the T-Mobile Park Parking Garage on the date of the applicable game, a prize pack, and the opportunity for the Honoree to be featured on the video board at T-Mobile Park during the applicable game (each, an "Award"). TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED. (Approximate Retail Value of each Award: $350.)

Each Honoree is fully responsible for any and all applicable federal, state, territory, provincial and local taxes (including income and withholding taxes). All costs and expenses associated with the Award acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Award are the sole responsibility of each individual Honoree. The Mariners reserve the right to substitute any Award (or any portion thereof) with an award of comparable or greater value in their sole and absolute discretion. All Awards are non-transferable and non-assignable, with no cash redemptions except at the Mariners sole and absolute discretion. All Award details, including, without limitation, the exact nature and duration of the in-game video board recognition, shall be determined in the sole and absolute discretion of the Mariners. TRANSPORTATION TO/FROM THE GAME AND LODGING NOT INCLUDED. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see mlb.com/ticketback for details. Seat locations at the game shall be determined in the sole discretion of the Mariners. Each Honoree’s guest(s) must be of legal age of majority in their jurisdiction(s) of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each Honoree and his/her/their guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the Award. The Mariners and the other MLB Entities reserve the right to remove or to deny entry to any Honoree and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game. Major League Baseball game tickets awarded in connection with the Program may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and Award forfeiture.

Honorees will be notified via email or phone prior to September 30, 2021.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROGRAM OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROGRAM MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE MARINERS WILL DISQUALIFY ANY INDIVIDUAL RESPONSIBLE FOR THE ATTEMPT, AND THE MARINERS, MLB AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

As used in these Terms and Conditions, the "MLB Entities" shall mean the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLB”"), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs ("Clubs"), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.

By participating in the Program and submitting a nomination or giving permission to be nominated, each participant agrees to (a) be bound by these Terms and Conditions, including all entry requirements, and (b) waive any and all claims against the Mariners, the other MLB Entities, and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Program, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Program or from the receipt or use of any Award (or any portion thereof) or any travel or activity related to the receipt or use of any Award (or any portion thereof).

Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; wireless service congestion; failures or malfunctions of phones, phone lines or telephone systems, wireless towers or cellular tower equipment; any error, omission, interruption, defect or delay in wireless or other transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical or other errors appearing within these Terms and Conditions, in any Program-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the processing of entries, the announcement of the Awards or in any Program-related materials, or the cancellation or postponement of any Major League Baseball game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Program. Released Parties are not responsible for injury or damage to entrants' or to any other person's computer and/or wireless device related to or resulting from participating in this Program or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Program or website or attempt to undermine the legitimate operation of the Program by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of the Mariners and/or MLB or who are in violation of these Terms and Conditions, as solely determined by the Mariners, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Program is unlawful and subject to legal action by the Mariners, MLB and/or their respective agents. The Mariners shall have the sole right to disqualify any entrant for violation of these Terms and Conditions or any applicable laws relating to the Program, and to resolve all disputes in their sole discretion. Released Parties (a) make no warranty, guaranty or representation of any kind concerning any Award (or any portion thereof), and (b) disclaim any implied warranty. The Mariners failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.

In the event that the Program is challenged by any legal or regulatory authority, the Mariners reserve the right to discontinue or modify the Terms and Conditions, or to disqualify nominations submitted by individuals residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any nominators whose nominations are disqualified due to such an action.

Each entrant agrees that (a) any and all disputes, claims, controversies or causes of action arising out of or relating to this nomination form, or any Awards awarded, shall be (i) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (ii) settled by binding arbitration in King County, Washington before a single arbitrator appointed by JAMS in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Terms and Conditions shall be governed by and construed and interpreted in accordance with the laws of the State of Washington, U.S.A, applicable to contracts entered into and performed exclusively in that State.
