A's Community Fund 50/50 Raffle
OFFICIAL RULESOVERVIEW: The Oakland Athletics Community Fund ("Fund") will conduct "50/50" raffles ("Raffle(s)") at select Oakland A's home games ("Games") played at the Oakland Coliseum (“Stadium”). The Fund is an organization registered to conduct such Raffles under California's Major League Sports Raffle Program under registration number 2024-07. These are the Official Rules, effective March 25, 2024 and until further notice, that, along with applicable law and regulations will govern all Raffles. The Fund reserves the right to modify these Official Rules at any time.
A "50/50" Raffle is a raffle in which the gross receipts from the Raffle are split 50 percent each between the winning ticketholder (minus any applicable withholdings) and the Fund or eligible recipient organization as defined by California Penal Code section 320.6, subdivision (d)(4)(A), which uses its share of the proceeds for charitable purposes.
Each Raffle, and all tickets, transactions, participants, purchasers, winners and other aspects of the Raffle, are subject to these Official Rules, California Penal Code Section 320.6, all regulations adopted pursuant thereto, and any and all other applicable laws and regulations.
The Raffles will be operated exclusively by The Oakland Athletics Community Fund, and not by Athletics Investment Group LLC d/b/a the Oakland Athletics or any of the other MLB Entities (as defined below).
ENTRY: At select Games, Raffle tickets will be sold throughout the Stadium from the time Stadium gates open to the public through the end of the 7th inning (the "Entry Period").Major League Baseball Game dates, times, and gate opening times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the Oakland A's, as applicable, and are subject to change. If a scheduled Game is not played for any reason, there will be no Raffle conducted on the date of that Game. If for any reason the Entry Period commences and the Game gets postponed due to weather or any other unforeseeable circumstance, the Entry Period would conclude three hours from the time the gates open. If the Game is canceled prior to the completion of 7 innings of play, the Entry Period shall be deemed to have ended at the formal Stadium public address announcement, and winner will be selected from the tickets purchased up until that point.
Tickets may be purchased with debit/credit cards or contactless payment (cash not accepted) in United States dollars (U.S. $), as follows:
(a) One (1) Ticket for Five Dollars ($5);
(b) Three (3) Tickets for Ten Dollars ($10);
(c) Twenty (20) Tickets for Twenty Dollars ($20); or
(d) Eighty (80) Tickets for Forty Dollars ($40).
Ticket prices and quantities are subject to change at the sole discretion of the Fund in the occurrence of a special event or promotion. No discounts or complimentary tickets will be provided. All Raffle ticket sales are final, and no refunds or replacements will be issued. Each ticket number purchased will provide one (1) entry in the drawing for the winner of that Game's Raffle and is not eligible for any past or future 50/50 Raffle drawing. Raffle tickets will be sold only in areas where an event ticket is required for admission to view the game.
ELIGIBILITY: Each Raffle is open to all ticketholders to Oakland Athletics home games who: (i) are eighteen (18) years of age or older as of the Game date; (ii) are physically present at the Stadium to purchase the ticket; and (iii) provide valid government-issued identification upon request. Each purchaser of a Raffle ticket agrees to abide by all terms of these Official Rules, subject to all applicable laws and regulations.
No person employed by or affiliated with the eligible organization, affiliated sports team or affiliated association holding the registered event, or the eligible recipient organization benefitting from the registered event, or the registered manufacturer and distributor of raffle-related products or services whose products or services are used during the registered event, may participate in any registered event as a raffle player or receive a raffle prize and such persons are classified as "Prohibited Entrants''. Prohibited Entrants are the following entities and each of their affiliates: Bump Worldwide Inc., Paysafe merchant Services Corp, the Oakland A's Community Fund, Athletics Investment Group LLC, any sponsor of a Raffle, the Oakland-Alameda County Coliseum Authority, AEG Management Oakland, LLC, Aramark, AMR, Staff Pro, ProPark, Fanatics Retail Group Concessions Inc., Elite Show Services Inc., Parkhub, Falck, MSA Security, Allied Universal Security, any other business licensed to operate within the Stadium and/or the Coliseum Complex grounds; any eligible recipient organization designated by the Oakland A's Community Fund; any other registered manufacturer or distributor of raffle-related products or services; and the MLB Entities. The "MLB Entities" shall mean the Office of the Commissioner of Baseball ("BOC"), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., the Major League Baseball Clubs ("Clubs"), The MLB Network, LLC, each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities.
Raffle ticket numbers are only valid for the date on the ticket. A Raffle ticket is void and its holder is ineligible to win the Prize if there is sufficient evidence, in the sole discretion of the Fund, that the ticket was improperly issued, printed in duplicate or in error, counterfeited, stolen, illegible, altered or subject to other similar or dissimilar material deficiencies. The Fund will have no liability with respect to printing errors in any raffle-related material or any misdirected, incomplete, lost, late, or illegible tickets or other errors or problems that may limit the entrants ability to participate in or win any 50/50 Raffle. Unauthorized persons copying, selling or altering Raffle tickets or otherwise undermining the legitimate operation of a Raffle are subject to prosecution.
DRAWING AND NOTIFICATION OF PRIZE WINNER: Following the conclusion of the Entry Period, the gross receipts from that Game's raffle will be electronically tallied, and the prize amount of the Raffle will be determined and publicly announced. During the 8th inning, the winning ticket number will be drawn by hand through a random drawing of all Raffle ticket numbers sold at the Stadium that day. Ticket holders need not be present at the time of the drawing in order to win. In the event of a weather delay, the Fund may, in its sole discretion, modify any pre-determined schedule with respect to the Entry Period and/or the drawing. The decisions of the Fund are final and binding on all matters relating to any Raffle.
The winning Raffle ticket number will be announced after the 8th inning. The winning ticket number will be (a) posted on the Stadium videoboards and at the 50/50 Raffle kiosk located at Section 217, (b) announced via the Stadium's public address system, and (c) posted online at the A's Community Fund 50/50 Raffle page (athletics.com/raffle) within three (3) business days of the game date. In the case of a discrepancy between the announced number and the actual number, the actual number drawn will be considered to be the valid winning ticket. The Fund has no obligation to contact the winning ticket holder directly.
To claim any Prize, the potential winner must do the following, in person, either at the 50/50 Raffle Kiosk located at Section 217 (before the end of that Game) or, thereafter, by appointment at the Oakland Athletics Headquarters located in Jack London Square: (a) present the purported winning Raffle ticket for validation as containing the prize winning draw number; (b) complete and sign the appropriate Prize Claim Forms; and (c) complete and sign all applicable tax forms. The purchased Raffle ticket is the only valid receipt for claiming a prize and must be redeemed in person.
Once those steps have been timely completed to the reasonable satisfaction of the Fund, each winning Prize, in the form of a check in the amount of the Prize net of any applicable tax withholding, to the person and at the address specified in the Prize Claim Form will be mailed 6 to 8 weeks thereafter.
PRIZE: Each Raffle winner will receive one-half (1/2) of the total gross receipts collected by the Fund on the applicable Game day (the "Prize"). The other half shall be retained by the Fund for distribution to charitable organizations in accordance with applicable law. Prize winners will be subject to all withholding tax and other federal, state and local tax requirements. Pursuant to IRS regulations, the Fund will be required to withhold taxes on Prizes with net proceeds (Prize minus ticket cost) over $5,000 and report this amount to the IRS. The organization will issue IRS-required documentation to Prize recipients as necessary by January 31 of the year after the year of the raffle.
Any Prize that is not properly and timely claimed, and any Prize check mailed that is returned undeliverable, shall be deemed forfeited and the Prize amount shall be retained by the Fund. Any Prize remaining unclaimed within 30 calendar days after the date in which the Raffle was held will be retained by the Fund. Potential winners may also choose to waive their right to receive a prize at which time the prize from the drawing will be forfeited and the prize money will be retained by the Fund.
PUBLICITY RELEASE: By purchasing a Raffle ticket, each ticket holder agrees to have his or her name, photograph, image and likeness, and voice published, broadcast and otherwise reproduced by the Fund, the Oakland A's and the other MLB Entities in any media or format, worldwide, for publicity and promotional purposes, without notice, review or approval and without further payment or consideration, for an unlimited duration (except where prohibited by law).
RELEASE: Each person who purchases a Raffle ticket (a “Participant”), together with his or her personal representatives, heirs, successors and assigns, agrees to defend, indemnify, release and forever discharge the Oakland A's Community Fund, Athletics Investment Group LLC, the MLB Entities, and the respective present and future affiliated entities, owners (direct and indirect), officers, directors, employees, agents and committees of the foregoing persons or entities (together, the "Released Parties"), from and against any and all claims, injuries, losses, damages or liabilities of any nature whatsoever to persons or property, which such Participant may now or hereafter assert, including but not limited to claims for injury, death, illness or damages, resulting in whole or in part, directly or indirectly, from participation in any Raffle and from acceptance, receipt, ownership, possession, misuse or use of any Prize.
GOVERNING LAW AND DISPUTE RESOLUTION: Any disputes in any way concerning these Official Rules or any Raffle shall be resolved in the State of California and governed under California law, without reference to its conflicts of law principles. As a condition of entering a Raffle, each entrant agrees that any and all disputes, claims, controversies, or causes of action arising out of or relating to a Raffle or any Prize awarded ("Claims") shall be (a) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (b) settled by binding arbitration in Alameda County, California before a single arbitrator appointed by the American Arbitration Association in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. A Raffle purchaser’s sole and exclusive remedy for any claim against the Fund arising out of the sale of 50/50 Raffle tickets or the conduct of the 50/50 Raffle shall be limited to the return of the purchase price paid for his/her Raffle ticket(s).
DISCLAIMER: The Released Parties have made no representation, warranty or guarantee, expressed or implied, in law or in fact, relative to the operation of the Raffles or to any Prize, and are not responsible for any errors in Raffle operations, Prizes or materials. The Fund may modify, suspend or postpone any Raffle to the extent in its judgment necessitated by, infection, tampering, fraud, unauthorized intervention or technical failure or by force majeure or any other reason beyond its reasonable control. Any failure to enforce any provision of these Rules shall not constitute a waiver of that or any other provision.
ELIGIBLE ORGANIZATION: The Oakland A's Community Fund is a California non-profit organization, which operates under IRC Section 501(c)(3) tax exempt status and which raises money for distribution to charitable organizations. Registered under the California's Major League Sports Raffle Program under registration number 2024-07. The Athletics Investment Group LLC, owns and operates the Major League Baseball team known as the Oakland Athletics. While the two entities are affiliated, each is a separate legal entity, distinct from the other. The Oakland Athletics Community Fund is conducting the Raffles at Oakland Coliseum with the permission of the Oakland Athletics, but the Oakland A's Community Fund is solely responsible for the operation and conduct of the Raffles.
