Rally Pro Contest

Effective Date: These Rally Pro Contest terms are effective as of March 31, 2021.

Rally Promotion and Rules: The terms below describe the parameters of the Rally Pro Contest (“RPC”), which is part of the Promotion and apply to you if you enter an RPC. As a reminder, the Promotion’s Official Rules govern your participation in the Promotion and any of its Contests, subject to the below. Capitalized terms used but not defined in this Section 4(C) will have the definitions set forth in the Promotion’s Official Rules. In the event of a conflict between the Promotion’s Official Rules and the terms of this Section 4(C), the terms of this Section 4(C) will govern with respect to how RPC entries are scored and prizes are awarded.

Contest Description and Entry Period: RPC is an App Only Contest which invites participants to compete by submitting certain solicited predictions regarding outcomes, including each “at bat” outcome, of a single Major League Baseball game (each, an “MLB Game”) scheduled to take place on the day of the applicable RPC. Except as may be otherwise announced within the App, an RPC will take place on each day of the 2021 Major League Baseball season, provided that one (1) or more MLB Game(s) is actually played on such day. If no MLB Game takes place on any given day within the Promotion Period, no RPC shall be conducted for such day. For each RPC, the App will solicit certain predictions to be made prior to the official start of an MLB Game (“Pre-Game Predictions”) and/or certain predictions to be made during an MLB Game (i.e., while the MLB Game is in live play) (“In-Game Predictions” and together with Pre-Game Predictions, the “Predictions”). The prompts for each solicited Prediction will display points which may be earned for such Prediction. RPC participants will accrue points for correct Predictions submitted and recorded in accordance with these Official Rules, including the Deadline (as defined below). The number of Predictions solicited for any MLB Game may vary across each RPC. The entry period for each RPC will begin on or about 10:00 AM ET (as announced within the App) and end at the conclusion of the final MLB Game for the day. Registered Promotion participants must submit one (1) or more Predictions prior to the Deadline to receive an entry in RPC.

Entry Limit: Limit one (1) RPC entry per person/per day. Be aware that the App will permit you to submit Predictions for multiple MLB Games. If you submit Predictions in connection with multiple MLB Games, your points will not aggregate across all such MLB Games. Rather, your points for each MLB Game will be separately calculated and your highest scoring set of Predictions (i.e., for a single MLB Game) will be used for RPC competition. For the avoidance of doubt, your RPC entry will be comprised of the Predictions you submit in connection with a single MLB Game and will compete with entries submitted by other participants in connection with any of the day’s MLB Games.

Prediction Deadline: You may change your RPC Predictions up until the following deadlines, at which point your submitted Predictions will be “locked” for scoring purposes (collectively, the “Deadline”): (i) Pre-Game Predictions will be locked at the time of the first pitch of the applicable MLB Game and (ii) In-Game Predictions will be locked at the time of the start of the MLB Game event contemplated within the prompt (e.g., if the In-Game Prediction concerns the outcome of an inning, then the Deadline is the start of the applicable inning; if the In-Game Prediction concerns the outcome of an at-bat, then the Deadline is the start of the applicable batter’s turn at the plate). To be scored for competition purposes, your Predictions must be submitted and recorded by the Sponsor prior to the applicable Deadline. No points will be awarded for Predictions submitted or recorded after the applicable Deadline.

Prizing: The Prize(s) for each RPC, and the number of winners to be selected for each Prize, will be announced within the App on or about 10:00 AM ET of the applicable RPC date. Limit one (1) RPC Prize per person/day. For the avoidance of doubt, if you win a prize in one day’s RPC, you are eligible to compete and win a prize in a separate day’s RPC.

Scoring:Participants will accrue points for correct Predictions in accordance with the points value displayed for each Prediction. Participants may also accrue bonus points for correct In-Game Predictions, as follows:

  • For each MLB Game, RPC will display a segmented “bonus” bar and available bonus points associated with such bonus bar. For each correct In-Game Prediction submitted and recorded in accordance with these Official Rules, one (1) segment of the bonus bar will “fill” and when all segments of the displayed bonus bar are filled, the participant will earn the bonus points associated with such bonus bar.
  • If the participant submits and records enough correct In-Game Predictions to fill the displayed bonus bar and earn the applicable bonus points, a new bonus bar will display
  • A participant will not receive any bonus bar points unless he/she “fills” all segments of the bonus bar (i.e., submits a correct In-Game Prediction for each segment).

Sponsor will score entries and assign points in real-time and in accordance with the below.

  • Predictions concerning the final outcome of an MLB Game will be scored immediately upon the conclusion of the MLB Game and Predictions concerning the outcome of an in-MLB Game event (e.g., a bat appearance or an inning) will be scored immediately upon the conclusion of the applicable event.
  • In the event that, for any reason, a solicited Prediction concerns an MLB Game or MLB Game outcome or event which does not take place (e.g., an MLB Game is cancelled or an In-Game Prediction concerns a specific anticipated batter who has been replaced by a substitute batter), such Prediction will be void and will not be scored for purposes of RPC competition.
  • In the event that, for any reason, an MLB Game is suspended for the day (e.g., for severe weather), Sponsor will score the Predictions submitted and recorded up until the time of suspension. For any MLB Game which is suspended and resumes play on a subsequent date, the resumed portion of the MLB Game and any associated Predictions will be void and will not be scored for purposes of RPC competition.
  • In the event that, after Sponsor has scored and issued points for any Prediction and the applicable MLB Game or event outcome is changed, corrected, or otherwise adjusted by Major League Baseball (e.g., following an instant replay review or following review initiated by a Club), points awarded within RPC for the applicable Prediction will not be changed, corrected, or otherwise adjusted, even if such change, correction, or adjustment is anticipated by an RPC participant.
  • Sponsor reserves the right, but assumes no obligation, to correct and update RPC scores based on errors or irregularities in the tabulation, transmission, or publication of MLB Game outcomes or Prediction scores.

The decisions of Sponsor are final and binding with respect to RPC scoring and in all other RPC matters.

Winner(s): Subject to verification of eligibility and compliance with these Official Rules, the entrant(s) who earns the highest score(s) will win the Prize(s) announced for such RPC, provided that in the event of a tie for any RPC Prize, the award of all Prizes will be subject to the Split Prize Rule (as defined below), and further provided that if the tied-for Prize includes any non-cash components, each of the tied winners will receive the non-cash component. The “Split Prize Rule” means that, in the event of a tie, (i) if the RPC features a single Prize, the cash component of the Prize will be equally divided and shared among the tied winners and (ii) if the RPC features multiple Prizes (i.e., first, second, third, etc., Prizes), then the cash component of the Prizes will be distributed as follows: (A) Sponsor will calculate the number of tied winners for any Prize level (“Tie Number”); (B) Sponsor will combine the tied-for Prize with the lower level Prizes until the number of combined Prizes equals the Tie Number (or no additional lower level Prizes are available); and (C) such combined Prizes will be equally divided and shared among the applicable tied winners.

See the below-listed examples of how ties will be resolved:

  • If an RPC features a single Prize comprised of $100 and a t-shirt and two (2) tied entrants qualify to win the Prize, each of the two (2) tied entrants will receive $50 and a t-shirt.
  • If an RPC features a first Prize ($1,000), a second Prize ($500), and a third Prize ($100) and one (1) entrant qualifies to win the first Prize, two (2) tied entrants qualify to win the second Prize, and one (1) entrant qualifies to win the third Prize, the first Prize qualifier will receive $1,000, the two (2) entrants tied for second Prize will each receive $300, and the one (1) entrant who qualified for the third Prize will be eliminated from Prize contention.
  • If an RPC features a first Prize ($100), a second Prize ($50), and a third Prize ($10) and one (1) entrant qualifies to win the first Prize, one (1) entrant qualifies to win the second Prize, and five (5) tied entrants qualify to win the third Prize, the first Prize qualifier will receive $100, the second Prize qualifier will receive $50, and the five (5) tied entrants who qualified for the third Prize will each receive $2.
