ELIGIBILITY: The Sweepstakes is open only to legal U.S. residents of California who are eighteen (18) years of age or older at the time of entry. The following persons are not eligible to participate: Employees, contractors, directors, and officers of Frito-Lay, Inc. ("Sponsor"), its parent, subsidiary and affiliated companies, distributors, participating retail locations, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, "Promotion Parties"), the MLB Entities (defined below), and the immediate family members (spouse, parent, child, sibling, grandparent, and/or "step") of each and those living in their same households (those persons whether related or not who live in the same residence for at least three [3] months during the twelve-month period preceding the start date of the Sweepstakes).
SWEEPSTAKES PERIOD: The Sweepstakes begins on August 2, 2021 at 12:00:00 p.m. Pacific Time (“PT”) and ends on August 30, 2021 at 11:59:59 p.m. PT (“Sweepstakes Period”). The time clock of the computer administering this Sweepstakes is the official timekeeping device for this Sweepstakes.
TO ENTER: During the Sweepstakes Period, visit www.Dodgers.com/FritoLay (“Web Site”) and follow the on-screen instructions to register and properly submit an entry to receive one (1) entry into the random drawing. See Section 4 for drawing details. See Section 5 for prize details. All entries must be properly received and recorded within the Sweepstakes Period in order to be eligible to win a prize.
Limit one (1) entry per person/email address per day. A “day” is defined as the twenty-four (24) hours between 12:00:00 a.m. PT and 11:59:59 p.m. PT of the same day with the exception of the first day of the Sweepstakes Period which shall begin at 12:00:00 p.m. PT and end at 11:59:59 p.m. PT of the same day.
If entering with a mobile phone or other web-enabled device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. Check with your wireless service provider for details on these and any other applicable charges. Entrants are solely responsible for any such wireless charges. Mobile entry is not required to submit an entry or win a prize in this Sweepstakes.
All entrants must have a valid email address. Multiple entrants may not share the same email address. A potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such account. Each entry must be manually key stroked and/or manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these or related email addresses or IP addresses may be blocked. If it is discovered that an entrant used multiple email addresses, phone numbers and/or mailing addresses, and/or manipulated such information, for the purpose of obtaining more than the stated number of entries, such person will be disqualified and any prize won shall be forfeited.
RANDOM DRAWING; ODDS: The potential winner will be selected in a random drawing to be held on or about September 1, 2021 from among all eligible entries received by an independent judging organization whose decisions shall be final. Odds of winning depend upon the number of eligible entries received.
PRIZE DETAILS: One (1) prize will be awarded. Winner receives four (4) Dugout Club tickets for winner and three (3) guests to attend the Los Angeles Dodgers home game on September 14, 2021 at Sponsor's sole discretion; one (1) customized replica Los Angeles Dodgers jersey (style, size and customization of the jersey will be determined by Sponsor and Los Angeles Dodgers, at their sole discretion); a private VIP stadium tour for winner and three (3) guests prior to the game; the opportunity to receive a pre-game meet & greet with a Los Angeles Dodger baseball executive or GM; and the opportunity for winner or one (1) of winner's guests to announce "It's Time for Dodger Baseball" prior to the game. Game is subject to availability and change. Transportation, accommodations, food, beverages, souvenirs and parking are not included and are solely the responsibility of the winner and his/her guests. Approximate Retail Value ("ARV"): $4,000.00.
PRIZE CONDITIONS: The exact duration and nature of the meet and greet opportunity, the announcement, and the VIP stadium tour is at the sole and absolute discretion of the Los Angeles Dodgers and Sponsor and subject to availability. Game tickets will be provided to winner via the MLB Ballpark app. See mlb.com/apps/ballpark for instructions on how to download the app. No alternative date will be provided unless date is changed by Sponsor, in Sponsor's sole discretion. If winner cannot attend the game on the date specified, they forfeit prize and Sponsor shall have no further obligation to such individual. Any and all other expenses or items not specifically listed herein are solely the responsibility of winner. Winner must accept prize as stated or prize may be forfeited.
Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see mlb.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Winner's guests must be of legal age of majority in their jurisdictions of residence, unless accompanied by a parent or legal guardian. Major League Baseball game date and time is determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize. Sponsor and the MLB Entities reserve the right to remove or to deny entry to the winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Sponsor and the MLB Entities will not be responsible for weather conditions; acts of God; acts of terrorism, civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition tickets. Sponsor and the MLB Entities are not liable for any missed events or opportunities or expenses incurred as a consequence of any transportation delay or in the event winner and/or a guest is late to the game (through no fault of Sponsor or due to Force Majeure Event).
WINNER NOTIFICATION: The potential winner will be notified by email and must respond to the email notification (as stated within the notification) within forty-eight (48) hours as to whether they can accept the prize or prize may be forfeited. Potential winner may also be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, Publicity Release within two (2) days of prize notification as indicated on the Affidavit. Sponsor is not responsible for suspended or discontinued wireless or online service which may result in a potential winner not receiving a prize notification; nor is Sponsor responsible for any change in a participant's email address, mailing address and/or telephone number (after he/she has provided such information). If (a) an attempted notification or prize is returned as undeliverable, (b) a potential winner does not respond to the prize-claim instructions, (c) any required documents are not returned within the required number of days, (d) a potential winner cannot be verified, or (e) a potential winner is otherwise unable to accept the prize as stated, the prize may be forfeited, in Sponsor's sole discretion. Jersey portion of prize will be shipped within six (6) to eight (8) weeks of winner verification.
LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor, the Promotion Parties or MLB Entities resulting from entrant's participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by Sponsor, the Promotion Parties or MLB Entities for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online or network communication problems; errors or limitations of any Internet or wireless service providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of the Web Site or an entrant's email account used in connection with the Sweepstakes. Sponsor, Promotion Parties, and the MLB Entities are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer or web-enabled device resulting from participation in the Sweepstakes. In the event of an identity dispute of an entrant, the entry will be considered made by the authorized account holder of the email account the entry is submitted from at the time of entry. The "authorized account holder" is the person who is assigned to the email account by the online service provider.
RELEASE OF LIABILITY: By participating in the Sweepstakes, entrants agree (a) to release Sponsor, the Promotion Parties, and the MLB Entities from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Sweepstakes; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs. Sponsor, Promotion Parties, and the MLB Entities are not liable in the event that any portion of the Sweepstakes (including any prize) is compromised, modified or canceled due to pandemics or epidemics, outbreaks of infectious disease or any other public health crisis including quarantine measures of any government authority or other restrictions, weather, fire, strike, acts of war or terrorism, government restriction, or any other condition beyond their control (a "Force Majeure Event").
GENERAL CONDITIONS: Winner is solely responsible for any taxes on the prize and will receive an IRS Form 1099 for the value of their prize, if applicable. No cash equivalent or substitution of any prize is offered, except at the sole discretion of the Sponsor. No transfer of a prize is permitted. Unclaimed prize will not be awarded. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. Prize is awarded "as is" with no warranty or guarantee, either expressed or implied by Sponsor, except manufacturer's standard written warranty included in the prize packaging, if any. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right to (a) cancel, suspend and/or modify the Sweepstakes, or any part of it, and (b) disqualify any individual who is responsible for such action. If terminated, Sponsor may, in its sole discretion, determine the winner from among all eligible entries received up to time of such action in a manner as determined by an independent judging agency. This Sweepstakes is offered only in California and all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Texas, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Collin or Dallas Counties, Texas.
